Hi there, I have a few questions about extending my WP this year. Last year CIC introduced some changes for LMIA exempt workers - the employer had to fill in IMM5802 and the Employer Declaration Form and give me a letter of invitation. Prior to me submitting my application, they had to submit IMM5802 and pay the employer fee, which they were then to give to me and I was to attach them to my application.
Now, I am looking at the required documents this year, and it says, among the rest of the documents, "Offer of Employment".
The document list did not seem to specify that it's supposed to be IMM5802 this year, but I found here http://www.cic.gc.ca/english/information/applications/guides/5553ETOC.asp that for LMIA exempt workers:
"If an employer is offering you a specific job, the employer must submit an Offer of Employment to a Foreign National Exempt from the Labour Market Impact Assessment (LMIA) (PDF, 1.12 MB) IMM 5802 directly to CIC prior to the submission of the work permit application by the foreign worker. The employer must also, at the same time as they submit the Offer of Employment, pay the $230 employer compliance fee directly to CIC.
If you have a job offer from a specific employer, please ensure that they have completed these two steps prior to submitting your work permit application."
I also found this http://www.cic.gc.ca/english/information/applications/guides/5802ETOC.asp?_ga=1.25435069.1817114601.145848845, so I guess it seems there is an Employer Portal through which the employer needs to do that, but it involves filling in a form rather than submitting IMM5802, though the required info seems the same. However, this document checklist here http://www.cic.gc.ca/english/information/applications/extend-worker.asp?_ga=1.83509142.1817114601.1458488459 states that I need to submit IMM5802 and the receipt myself, but I just took the application eligibility questionnaire and it seems the documents required are as above (Employer Questionaire and Declaration, Passport, Photo, Letter of Invitation, Job Offer, Proof of Qualifications. Does that mean that I no longer submit the IMM5802 myself and I no longer need the receipt?
So, my questions are:
1. Is the 'Offer of employment' that I need to submit still IMM5802, or do I need to get my employer to write me a letter stating the same information as on IMM5802 but which is not the form?
2. Does anyone have any experience with the Employer Portal? when the employer fills in the details, the worker info, the job description, the wages and benefits etc, and submits, does the offer get into the system automatically? In other words, can I apply for my WP immediately after they've done that, or do I need to wait?
3. I am paid by my foreign institution (I am an academic), so wages, benefits, work hours etc are all paid by them, not my Canadian employer. So, when my Canadian employer will be filling in the forms in their Employer Portal, are they to leave the spaces about wages and benefits etc blank, and in 'alternate compensation scheme' state that I am paid by my home foreign institution, or are they to fill in all the fields anyway? The same with benefits, can they just state in 'other benefits' that I get them from a foreign institution? I can see that these questions are almost exactly the same as those on IMM5802, but I want to clarify these answers since there is less flexibility with online forms than with paper forms.
4. Finally - where is the "Employer Questionnaire and Declaration"???? I am trying to find it, last year it was IMM5658, but I can't find it in the CIC search option and clicking on 'open in new window' on the required documents on 'my personal checklist' says there was an error :/ What is that, then? And where do I find it?
