Hi ,

MY current WP is getting expired in August mid . I am here on closed WP with LMO . Currently LMO application for extension is about to be filed(next week) .

My concern is on the impact it will have on PR . Since i am sure I cannot get the LMO approved and apply for WP extension before my current WP expires. Will it have any issue with the PR application ?

Let me give more details :

I cannot apply for extension before expiry of my WP which means I cannot work as well . By the time my WP expires , LMO will be in process and legally not allowed to work after WP expiration. My question is more on how it impacts if i continue to work since applying LMO and WP is totally in my company's hand and I cannot control the timelines.

My advice would be not to work at all once your work permit expires. If you do and CIC finds out, your CEC will surely be denied. However, if you apply for an extension of your WP before it expires, even though you know it would be denied, you can keep working till you get a response from them. That might give you a lil extra time till you get your LMO and then you would have to send in another application. You would be out an extra $150, but in the long run it might be worth it for you. But DON`T work after your WP expires if you did not apply to extend it before expiry. That would only bite you in the butt later on.

Any expert comments ? this is really making me worried..

You can apply for the the work permit before it expires and keep working. As long as you apply for extension before the expiry of current work permit you are allowed to work until the decision is made on your application. And once you receive the LMO call CIC call centre and let them know that you have recieved it. When work permit file will be opened by the officer will be able to see your LMO. The only thing is if the officer opens your work permit application before the approval of LMO he will refuse your work permit and than you would have to stop work but there is a good chance you will recieve your LMO before the file is opened. A friend of mine did the same and got his work permit.

Why not apply for BOWP to get rid of the lmo stuff? You are eligible since you have received your AOR and your permit would be expiring next month.

If you still want to work with same employer and he wants you to have a closed permit, then apply for wp (paper application) within 2 wks before the expiry of your existing permit so CIC will get hold of your app for 2 months. (yet to find the link where I've read it before)

CIC while processing your CEC app would never know if you have worked after the expiry of wp (assuming non-implied status) unless they ask next yr for 2013 noa (which I doubt) and when someone discloses it to CIC. But why work without auth? You wouldn't want to risk your future here, would you? Afterall, you've got a lot of options.

Thanks.

I know best option is to go for bowp but my employer will not support it.

There anyone who had applied for closed and open wp and what do we need for same

you don't need anything from your employer..it's easy and the best choice for you right now.

hi cgel.

I almost have the same situation here. My work permit will be expired in October 27, but I havent found any employer to do LMO for me yet. But i will keep trying.

I have a qusetion is: Did your friend submit the application to extend work permit before submit the LMO application or after? and Did the employer desmontrate your friend's name on the LMO application?

I really need to know and I will really appreciate your response.

thank you very much

Try asking your employer to apply for Accelerated LMO if he's eligible, I believe he is. That way he can have A-LMO within 2weeks.

If you have already applied for the CEC program and have the AOR, your best option is to apply for the BOWP. This is an open work permit, nothing is required from your employer. Read the info here - http://www.cic.gc.ca/english/resources/manuals/bulletins/2012/ob485.asp

If for some reason you want another TWP - as long as you have already applied for the LMO, you can submit your application to extend your work permit within the 2 weeks prior to the expiration date (LMO pending). As long as you apply for the new work permit BEFORE the old one expires, you will be on implied status (and may continue to work) until you receive a response from CIC.

If your LMO is not approved, then the new work permit will not, either.

Wo-ohhh, suspended since Apr. 29th of this year?... Thanks for correcting my post re: A-LMO...
