Hi Folks,

Could you please help me with following situation - I have a Canadian PR and currently reside in Ontario, Planning to take an offer from US firm (remote on H1B)
  1. Can I reside in Canada and work for US employer on H1B (Remote position)
  2. How does Taxation work?
  3. Do I need to have a residence in US bordering state
  4. Do I need to commute to US frequently?

Have you talked to your US employer about how long can you live outside of US? I know different companies have different policies.

A slightly different question- Is it more expensive for companies to switch an employee to the Canadian payroll from a US payroll? My company told me *they* have to pay higher taxes for me and increases the employee cost. My company has offices in both countries.

Hi, I am in the same situation. My employer would possibly pay canadian payroll since we have entity in both countries . But if I am getting Canadian payroll, does the h1b still valid. I have h1b visa stamp still valid . But my concern is that I am no longer working for US company since I am on Canadian payroll ? Will the h1b extension have some issue if on Canadian payroll ?

My 2 cents. Since you would move to a Canadian entity and no longer can access US via H1b you need to either get a B1/B2 or stay on US payroll to access US via H1b. Later when you plan to go back to US on H1b you can go for consular process and enter or if you become a Canadian by then you no longer need consular process but activate your H1 and then enter normally!
