Working/living under Closed work permit

Hello everyone,

I am currently on a closed work permit for my employer until May 2017. My work permit says I can only work for that employer. However the problem is my employer was running out of business and wasn't able to afford me anymore which means I had to leave the job and it happened last week. Does it mean that I currently can't work anywhere else until I get my PR? I already applied for my PR in June 2015 and got my Application/File no. on August. Do I have to wait until my PR before I can start a new job? Can I still stay in Canada

1. Without a new LMIA you can't work for anyone else. You can't apply for a BOWP has your present work permit has more than 4 months validity.
2. You can remain in Canada until your work permit expires, you can't work (see #1) until you receive your PR.

Thank you for your response. However I am slightly confused regarding why I should require an LMIA. When I applied for my work permit in the summer of last year I didn't require an LMIA. My employer had to fill out an IMM5802 LMIA exempt form (http://www.cic.gc.ca/english/information/applications/guides/5802ETOC.asp) which I included with my application and received my work permit.

Thank you for your response. However I am slightly confused regarding why I should require an LMIA. When I applied for my work permit in the summer of last year I didn't require an LMIA. My employer had to fill out an IMM5802 LMIA exempt form (http://www.cic.gc.ca/english/information/applications/guides/5802ETOC.asp) which I included with my application and received my work permit.

Hi,

The application was made in May 2015, so it was different then what it is now. There was a pdf form that my employer had to fill out. The category was "Canada PT Agreements - R(204)C".

Also, I spoke to a lady working in PNP office today and she said, If I don't find another employer and apply for a new work permit my nomination could be revoked which may cancel my PR. Is it true ? It doesn't make sense since, I will be able to start working when my PR comes anyway which I am hoping will come within the next 2-3 months. And I thought I can just use this time as holiday and find a job so that I can immediately start working after my PR.

Even if I find an employer and apply for a new work permit it will take 4-5 months and I still wont't be able to work untill then. I am really confused and scared

Your old work permit was LMIA exempt. If you want to apply for a new work permit, you have to qualify under the new rules. Unless there's a new LMIA exemption you qualify for, you need a new LMIA in order to obtain a new work permit. Do you qualify for an LMIA exemption under the current rules - if so, which current rule? (The old rules are irrelevant.)

Yes - your PR application can be refused if you don't find a new employer.

Oh Dear! I came all the way and it's almost towards the end. I honestly don't know whether I need an LMIA or not and also don't know where to get started. What should I do now?

Hello. Could you please enlighten me. Im here in Canada for more than one month and was issued a work permit under noc. 6471 - Visiting Homemaker, Housekeeper and other Buss. rel. ( new pathway )Then i have a remarks/condition stated - Applicant is not part of the lcp nor are they eligible to apply PR for this program. Mind asking if it would affect when i want to apply PR after 2 years? Thanks for responding to this

You cannot qualify for PR under LCP and NOC 6471 is not a skilled job, so you won't qualify under Express Entry. Unless you can qualify under a Provincial Nomination Program, you will not be eligible for PR.

Would you please Guide me that I have been working since last one year as a live in care giver for senior citizens ,but remarks showing applicant is not the part of LCP and nor are they eligible to file PR under this program.and my NOC code and title is 6471ersonal care provider.would I be eligible to file PR. After meeting the requirements of to apply PR. My occupation is mentioned with live in care giver program.
