Working in Vancouver Question

Hi Everyone,

I have a question to ask about my current situation.

On November 27th 20014 i applied for a Self Employed Visa under the Business Class because its my dream to work in Canada. About 3 weeks ago my company finally decided to send me over to Vancouver to work for the Canadian office. Now heres the problem. I hold an Indian passport and because of this i cannot do what other people did, which is apply for a work permit and then collect it at the Vancouver airport. Instead i am told to apply for a Business visitors visa and once im in Vancouver i can apply for a Work permit through my company.

Now i am about to apply for my Business Visitors visa but i have a burning worry about my PR application which is still in process. Should i cancel it before applying for either the Visitors or workpermit? Please advice what i should do. I dread that my chances of working in Vancouver have become slimmer as i have a PR application AND im applying for a Business Visitors pass AND a workpermit right after.

I understand that once im in Vancouver with a business visitors pass i can apply for a work permit and stay in canada because of Dual intent. But wont the PR mess all this up? Should i cancel my PR? Also if i DO cancel it, will it further cause me issues ?

Someone has been giving you very bad and dangerous advice. You cannot use a Business Visa to come to Canada to start working for your company and then file a work permit from within Canada to continue working for your company. This is not what Business Visas are for - they are meant for those who plan to come to Canada for a short time and then leave. They are not meant for people who have plans to live in Canada to work or who have plans to enter Canada's labour market (which you do). If you try this - you will very likely have issues entering Canada (there's always a chance you could end up with an exclusion order for 1 year for using the Business Visa improperly) or issues applying for the work permit from within Canada (since CIC will say that you used the Business Visa fraudulently to enter Canada). If your company wants you to move to Canada to work for them - you need to apply either for an Intra-Company Transfer work permit or a regular work permit (which needs an approved LMIA) from your home country and that work permit needs to be approved BEFORE you come to Canada.

Hi,

Thanks for your reply. This is what my company said - My first step is to get a visitor's pass to enter canada. While im in Canada i can apply for a Work permit. But im still worried about my PR application which i applied for back in November 2014. Will my ongoing PR application which i applied several months ago affect my current visitor visa and work permit application?

You're worrying about your PR application needlessly. That's not where the problem and danger is. The issue is with what your company has told you to do. They don't seem to understand the work permit process at all.

Oh i see.. Oh boy time to have a chat with my company. So you are saying its not possible to get in as a visitor and then change my status from visitor to Work permit? Even if the company is doing an intra company transfer?

In your first post you mentioned coming over to Canada on a Business Visa - now you are mentioning a visitor visa. Which is it? You cannot go the Business Visa route because you have plans to enter Canada's work force. You could come on a visitor visa - but you can't work on a visitor visa.

You should also be aware that it's become quite a bit more difficult to obtain approvals for ICT. Your company will have to prove you have specialized knowledge they cannot secure in Canada.

Sorry for the confusion. The PR application which i had done was under the Self Employed visa which falls under the Business class.

The current situation with my company (PR is unrelated) is that they asked me to go to Canada as a Visitor first and THEN apply for a work permit while im inside Canada. The specialized knowledge shouldnt be a problem as i do have them :).

1. You can't apply for a work permit in Canada if you are there on a visitor/business visa.
