Work Permits while sponsored by hubby?

Hi All,
I hope you are well.

I have been reading lots on this forum and appreciate all of the time and effort that everyone has provided with their responses - lots of knowledge out there.... so I am hoping someone can help me with my simple queries and I hope I have come to the right category...

brief history: My husband is a Canadian Citizen and I am an Aussie Citizen, we have 4 children together and we have been married 6.5 years & counting.... My husband will be sponsoring me as an outbound application & we are all residing in Australia.

1. While I am being sponsored, am I able to gain employment in Canada, and if so, which work permit would I apply for? Is it the Open Work Permit or another work permit? Is it different for an Employer (me working for someone) as apposed to me 'working for myself'?

2. In Australia I have a home based 'hobby' which generates a 'seasonal' income. My home based 'hobby' is something I would like to continue doing and offer as a service within Canada. In order for me to continue doing this - are there any rules relating to me being able to, or not, while I am being sponsored by my husband?

2. Whether I am employed by someone else or work for myself, should the permit application be sent along with the Sponsorship forms at the same time, or is it easier to do this once arrived in Canada?

3. We are seeking advice as to whether our children are classed as Canadian Citizens or not (based on the new law that came into effect on 17th April 09), if they are, what information do we need to provide on the sponsorship form in order for them to be acknowledged as ours and dependents but being Canadian Citizens?

We are still going through all the paperwork requirements and I am plotting the timelines and schedules etc, I have my head around most things.... aside from the above and probably a few more unknowns along the way lol... I really appreciate the clarification/advice...

It depends if you are applying inland or outland (as an Aussia - you should really apply outland).

If you apply inland, you should include an Open Work Permit application with your inland application package. Once stage 1 processing has been completed (approximately 11 months after you submit your application), the work permit will be approved as well.

If you apply outland, you do not qualify for a work permit. You will qualify to work once your file has been approved and you have landed in Canada as a permanent resident. If you wish to work earlier, you will have to find an employer in Canada. That employer will then have to obtain an approved Labour Market Opinion in order to hire you (and prove they advertised the job and were unable to find a Canadian to train or hire for the role). And then finally you will have to apply for a closed work permit tied to that specific employer. Expect this entire process to take months (once you've found an employer).

Unfortunately you cannot continue your hobby in Canada while you are being sponsored by your husband outland. You'll have to wait until you become a PR before you can offer this service in Canada. (Doing so earlier will be classified as working and is illegal.)

It all makes sense and outland app all the way for us. We don't plan on landing until all the formalities are confirmed to us in Australia i.e. PR/Kids status approved...

With regards to your comment "You will qualify to work once your file has been approved and you have landed in Canada as a permanent resident"...

Once we have landed (with the formalities out the way from when we were in Australia).... is the 'ok to work' something that is automatically granted or are there other forms of paperwork that I would need to complete and if so what would they be?

I'll also have a go with various search strings based on what you have replied with to see if I can find this info.... otherwise, thanks again for your help...

Once your application has been approved and you have landed in Canada as a permanent resident, you can then apply for a SIN (social insurance number). As soon as you have your SIN, you will be able to start working legally.
