Hello,

I am on a work permit with an employer and its valid till dec 2012. I got an offer from a different employer and he is ready to process a work permit. But he told that LMO is necessary to do this process and might take 3-4 months.

My question is,
1. Can I still stay with my old employer till I get the new work permit?
2. Once I get the new work permit, will the old one gets automatically cancelled?
3. After I get the new work permit, I need to give 2 weeks notice to old employer and join the new one, Can I do that after getting new work permit?
4. Do I need to go out and visit inside the country again after I get my new Work permit?
5. Worst case, after I get my new work permit from new employer? Can I still stick with my old employer as I have my work permit till dec 2012?

Please advice,

The new employer needs to obtain a positive LMO before you can get a new work permit.

1. As long as your current work permit is still valid, yes you can continue to work.

2. You can only have one work permit at a time, so once the new one has been obtained you would be unable to work for your old employer. I'm not sure of the timeframe when going from one job to another.

3. I would think so, since you need to give notice, but not sure. Maybe a start date is placed on the work permit? And that would be 2 weeks after you have given notice. I really don't know...

4. Not sure exactly how that works.

5. Again, you can only have one valid work permit at a time.

I'm sure someone else can answer better than I.

I would not share any of this with your current employer or any co-workers. As I am sure you know, there is no guarantee the LMO for the new job will be approved. Good luck to you!

Thanks for the info.

So, do you mean once I get my new work permit, I can have a grace period to give 2 weeks notice and move to other employer? How good are the chances to get LMO, are there lot of rejections during this process?

Some LMO's get approved. Some get denied. Mine was denied the first time but we are trying again after remedying the minor problem. I just read of someone else that was denied. They reapplied and then it was approved. Some are approved on the first try. Hopefully it will work out for you. But you just never know.
