Hello, I am a canadian citizen and my husband is from New Zealand. His one year working holiday visa expires on Nov 19th.
We were planning on driving to the USA boarder on the 17th and then coming back accross that same night and then he would
be re entering as a visitor. However I realized there may be a few problems with this plan..

Question 1:
Can he come across as a visitor while still having the "status" of a worker until Nov 19th? ( NZ does not need a visitor visa to enter)
will they just take out his work permit even though its not expired yet?

He has a letter from his employer showing the end of his employment and we have return tickets back to New zealand for december so i dont think they would think he is "flag poling"

ok thanks for your reply, what are reasons he may not be admitted into canada?
Will having a canadian wife and a place he is living have a negative effect?

The BO may decide it his intention to remain permanently, not visit with a Canadian wife. He would be much better to file his application to Vegreville and remain in Canada until he gets a response.

1.My concern is, on Dec 17th we are flying back to NZ , what if the visitor visa is not approved by then? Can we still leave?

2. When we fly back on jan 6th at the port of entry he will be applying to get a visitor record as a clergy. We can't apply for it now because the church has not finished writing the job offer letter but will having left while the visitor visa was in process effect him getting his visitor clergy record?

3. If he does get the visitor visa before we leave, when we come back can he apply for a clergy visitor record?

So we went to the canadian border and my husband went in and said to the border officer " Hey i would like to change my status from worker to visitor, can i do that here or do i have to cross into the states and re enter canada?"

The Border officer said " how long are you planning on staying in canada as a visitor"
husband said " about a month until i fly out"
Border officers hands him back passport and says " dont worry about it"
Husbands says " what do you mean?"
officer says " as long as your not working you can stay in canada until you leave"
husband says " even without leaving the country first before my permit expires?"
officer says " Yes, we arent as strict as we used to be, as long as your not working, you can legally stay in canada for that one month until you leave"

WHAT THE HECK!!!??
If the border officer said this it must be true......
but has anyone heard of this?

Lazy or not bothering to do his/her job. Interesting you get checked after your status expires (it does happen) do you really think that the Investigator is going to believe what you were told at the border? I don't doubt that it happened, but no one from Immigration Enforcement would believe it.

It all worked out in the end!!
He went accross the USA border and came back into Canada and they gave him a 6 month visitor visa,
all he had to show him was his ROE and his return ticket!
