My wife's application for the extension of her work permit got refused because we failed to submit an additional document.
She has now 90 days to resubmit.
Our PR application is also under process now (RNIP)
She wants to go to India by december.
Do you think it is a good idea to go to india within these 90 days without applying for the restoration of work permit?
OR What happens if she goes to india while the application is under process?
OR Is it okay to apply for visitor visa instead?

It can be an issue for PR applications if one of the applicants is out of status in Canada. She should either apply for restoration immediately or have plans to return to India very soon. She will need a TRV to return to Canada. She can only apply for that TRV once she is out is of Canada.

It's not at all clear what you are asking.

Do you mean if she leaves Canada very soon and then applies for a visitor visa from outside of Canada?

Or do you mean remaining in Canada without applying for restoration and then applying for a TRV / visitor visa from within Canada?

Or something else? Again, not at all clear.

I addressed this in my first response.

This is not possible. She cannot apply for a TRV within Canada. She can only apply for the TRV once outside of Canada.

Can you please share the timeline for the restoration of your permit.

So our only path is to apply for restoration of work permit. Is there a step by step guide on doing this?

I'm not aware of one.
I have a doubt..
So my wife's work permit extension was refused from CIC, because I didn't upload a document on time. We are trying to restore the status. And I am filling 5710 now.

There is a question in it: Current country or territory of residence / Status / From / To

Her original work permit was valid until 30 Apr. (Issued 14 Nov 2022)
And as per the extension refusal, her work permit expired on 02 aug.

So how shall i fill this part?

Is it Canada/ Worker / 14 Nov/ 30Apr

or

Canada/ Worker / 14 Nov/ 02Aug

or something else?
