Hi everyone,
I completed my PG diploma and work for an year in Canada as quality control technician in a mushroom company my work permit was expired on Nov 2014 so my company applied for lmia but as mushroom picker I got a positive lmia but my employer has not entered lmia number on my work permit so that permit was refused in Feb 2015 but I never know it was refused I came to know that my work permit was refused on Aug 2015 as I was out of status I left Canada after a month . Now am in India and my employer applied for lmia and received a positive lmia so I hired a lawyer in Canada and applied for work permit from New Delhi visa office I filed my permit on Sep 15 and received a refusal on October 15 due to 3 reasons
Current unemployment status
Lack of financial assets and family ties
Overstay in Canada in previous visit to canada
Can anyone plus help me how can I make my file strong as am planning to reapply next week .
How to avoid refusal for 2 nd time

You're going to be refused again if you apply next week. You have a significant overstay in Canada and will need to spend time in your home country before you try applying for a work permit in Canada again. The refusal reasons CIC has listed cannot be fixed by next week.

I would recommend that you spend at least six months in your home country (a year would be better) before you try applying for a work permit to Canada again. During this time, you should make sure you obtain a full time job and establish ties to your home country (e.g. property ownership or rental).

scylla is write....just wait try to overcome your reasons given and fix them .....to create better chances of approval..
And try to explain your reason of overstay in canada in your next application...BY mean time try to extend or get some time for LMIA validity so that it won't expire or try to apply new one as its a time taking and long process now a days. Good luck.. :)

My employer received a positive LMIA and I applied last month but refused due to
Current employment status
Overstay
Family ties
Am reapplying next week as my LMIA is about to expire am planning to include a cover letter stating the exact reason . Am not sure will this really help me in the 2nd application
Please suggest me how can I improve my file what are the documents I can add to make my file strong

You can certainly include a letter to explain your overstay. I don't think this letter is going to help and I believe you'll be looking at another refusal.

Another thing you can do is ask your employer to write a letter and explain your reason of overstay in Canada but still I would recommend spend some time in your home country and try to create some strong ties like try to find a job, buy porperty or make yourself financially strong. The recommendation is don't apply as it will be another refusal probably ( hopefully not) which will make your app or case more weak and it will tell the VO that you are trying to enter Canada at any cost..and since your are applying in very short period after being refused when there are no change in your circumstances , So it will be a w<iframe name="google_conversion_frame" title="Google conversion frame" width="300" height="13" src="https://googleads.g.doubleclick.net/pagead/viewthroughconversion/976231281/?random=1445266222039&cv=8&fst=1445266222039&num=1&fmt=1&guid=ON&u_h=1080&u_w=1920&u_ah=1040&u_aw=1920&u_cd=24&u_his=7&u_tz=-240&u_java=true&u_nplug=0&u_nmime=0&frm=0&url=http%3A//www.canadavisa.com/canada-immigration-discussion-board/index.php%3Faction%3Dpost2%3Bstart%3D0%3Bboard%3D10&ref=http%3A//www.canadavisa.com/canada-immigration-discussion-board/index.php%3Faction%3Dpost%3Btopic%3D363663.0%3Bnum_replies%3D5" frameborder="0" marginwidth="0" marginheight="0" vspace="0" hspace="0" allowtransparency="true" scrolling="no"><img height="1" width="1" border="0" alt="" src="https://googleads.g.doubleclick.net/pagead/viewthroughconversion/976231281/?frame=0&random=1445266222039&cv=8&fst=1445266222039&num=1&fmt=1&guid=ON&u_h=1080&u_w=1920&u_ah=1040&u_aw=1920&u_cd=24&u_his=7&u_tz=-240&u_java=true&u_nplug=0&u_nmime=0&frm=0&url=http%3A//www.canadavisa.com/canada-immigration-discussion-board/index.php%3Faction%3Dpost2%3Bstart%3D0%3Bboard%3D10&ref=http%3A//www.canadavisa.com/canada-immigration-discussion-board/index.php%3Faction%3Dpost%3Btopic%3D363663.0%3Bnum_replies%3D5" /></iframe>aste of money , time and throwing your case in the depth of negative responses from CIC and refusal.
So, be patient and try to create strong ties to your home country while you are in India try to convince your employer to apply for new LMIA or extension whichever is possible , if not then wait for atleast 3 months from the time of refusal as your will expire in Feb 2016.
Hope for the best and Good Luck... :)
