Hi all,
Experts help pls
Rightnow working in Vancouver and my closed work permit will get over by this friday may 18.I was thinking to apply for Visitor visa extension before my current work permit expires.

Meanwhile I got a new job contract from Montreal and currently lmia process is going on and assume I get work permit by june end.

My question is do I have to apply for visitor visa extension to fill the gap between two work permits to stay in Canada with legal status or is it ok to wait without doing anything.

I know there is a thing called restoration which should be applied within 90 days from the date permit expires.

Its bit confusing whether to apply or not.

Hi @balaprasad123,

I don't think, you can get a temporary resident visa extension based on your expiring closed work permit or based on the new contract job; also you cannot raise a request for new Open WP with IRCC (for your contract job, even though you have a sponsored employment) since your LMIA is still in progress. I think your best chances are - you can ask your current employer to apply for a closed WP extension (which should be LMIA exempt) by Friday EOD. But I am afraid, this is highly unlikely, unless your employer is aligned with you.
Once you receive the WP application number from CIC (in the do not reply email), you can stay in Canada on "implied" status, but you cannot leave Canada until there is a decision taken on your WP application.
If nothing works out, immediately consult a lawyer and discuss your options regarding how you can legally stay in Canada (so that you can apply for the Open WP, based on your new LMIA)

Be aware that, if you stay beyond your temporary residency visa period, your stay will be considered illegal. And this may affect your current and future application processings with IRCC.
Hope you can find a quick resolution with your case.

Hi.Thx for your response. Its impossible to ask my current employer for work extension. So I can rule out this option.

I believe TRV (sticked in passport) and getting visitor extension within Canada are two different things.I need a permit to stay in Canada as Visitor. When IRCC approves my visitor extension I will be issued a paper which looks like work or study permit docs.

Maybe I am wrong about understanding this whole thing :)

You are not wrong. Apply online ASAP to change your status to visitor. Do not let your status expire.
