I am a foreign worker, currently resident of Canada on a Visitor visa. I want to apply for work permit from inside Canada, but my LMIA will not be ready before 31st of August 2021. Do you think it is legal to apply for work permit and claim to be outside Canada while you are actually inside Canada. Is it the case of 1) illegal misinformation or 2) legally depriving your self from some advantages designed for applicants inside Canada?

Thanks in advance for you help

Claiming you are outside of Canada when you aren’t is misrepresentation. Not a road one wants to travel.

Thank you very much. I thought it just might be legal, and one is just depriving oneself from privileges of inland application.

Legal to misrepresent yourself on your application? In other words to lie ? Come on…..
However it’s a excellent way if your goal is too be potentially banned for five years.

How do you know that your employer will only hear about whether their LMIA is approved or denied before August 31st? Is this a high skilled specialized job? Given Canada still has many people who are still unemployed it could be difficult to get LMIA approval or WP approval in some industries and areas of the country.
