Work permit for my wife while I wait for PR

Hi all,

In June I will submit my PR application as CEC under my name. My wife has been working here in Canada for less then 1 year under an open work permit associated to my closed temporary work permit (hence she cannot apply for PR as CEC).
Since I expect that my WP will expire before I will get the PR and I am not 100% sure my company will keep me on board, I was thinking that my wife should apply for her own work permit (not associated to mine). This in order to be sure that even in the case mine will expire and will not be renewed by my company, she can keep working with her current employer.
If she will receive her WP before expiration of mine, my idea is that we cross the boundary and I can re-enter with an open WP associated to hers until I will get the PR status.

Here the questions for you guys:
1. Does the above make sense and is it correct in your opinion?
2. Is there a better way to follow?
3. In case there is no other way you suggest I should follow, what is the type of WP my wife should apply for?

Thank you very much.

From the details you provided, your wife isn’t eligible to apply for a work permit on her own account. She can only get one that is associated to yours since you currently have a high skilled job.

Once you receive first stage approval, you can apply for a bridging open work permit four months before your current WP expires. See here: http://www.cic.gc.ca/english/department/media/notices/2012-12-17.asp

Why do you believe she can't apply? What are the requirements she should satisfy for doing it?
I was thinking that since she has already a job and she can get a confirmation letter from her employer there should not be issues on getting a WP. Based on the fact that her employer will require her to stay is not possible to apply through it?

She definitely can apply for her own WP but her employer need to apply for LMO first and get positive decision (confirmation letter is not enough).

You asked if she could apply for a work permit on her own - which I took to mean, can she get a work permit by virtue of having a job already. She can't, not unless she has an LMO as pfse said. Your wife's employer needs to first advertise the job for four weeks in three sites, prove no Canadians were available (as well as meet other criteria)... and if successful in getting a positive LMO, then she can apply for a closed work permit.
