Hello,

I came to Canada with CUAET and that gave me 3 years open work permit it is going to be valid until January 2027. I have a chance to extend this permit one more year and deadline is soon for application. If I apply for the new work permit my previous one will be still valid together with the new one or no ? I am worrying if they refuse my new application is that means I am going to lose also the one that I am holding now or regardless I get approved for new one or no I will be still able to keep the existing one?

Shouldn't affect your current WP but it's wiser to explore PR pathways instead of WP extension imo.

Thank you for your message. I actually did not stay enough in Canada to apply for a PR and i just want to use this benefit for now. When we apply for extension there is an automatic letter comes and say that our workpermit exist until the new decision is made and says we should not leave the country. But i don’t think this applies for us, if we have a valid work permit and visa why we shouldn’t leave the country? I am just worrying if new application for extension doesn’t get approved can I still use the existing one until the expiry date. I called IRCC several times and they all gave me different information they did not have clear information on that. We applied for my partner to extend after 9 months she got approval but work permit did not arrive to the address that we gave. We do not know if the one she still has is cancelled due to new permit or it is still valid.. so confusing.

It is a bit tricky but here's how it works, at least in theory.

The last application to be processed should become your current status. If it's an approval, there's nothing to worry about but if it's a rejection, there will be notes informing you about your current status, specifically when it ends.

If you have a valid work permit and a TRV(not sure if Ukrainian nationals need a TRV due to current situation but IRCC website says yes), you can travel. The maintained status is when your previous status expired and you applied for extension. It's normally not recommended to leave Canada on maintained status but that's not the case with you.

The easiest way to confirm if a document is valid is by calling IRCC. Might get a bit of runaround but if you are persistent, you will find the answer.

I do not know about trv but i have multi entry visa along the permit.

We applied for my partner while we are not in Canada and we haven’t enter Canada during the time of processing and they approved the application but new work permit did not arrive to the address that we gave, do you think she can enter to canada with the visa and old permit?(old permit is also valid until 2027 like mine but i am not sure after they extended and issued new one is that still valid we dont know this)

You might be overthinking this. I highly doubt a rejection will lead to revoking applicant's current status given Canada's commitment to support Ukraine during the ongoing war.

I also doubt a rejection, there are no new policy changes to my knowledge. In case it is rejected, they will very likely inform that status is valid till the date of expiration of the current 'valid' permit. Canada won't force people back in to war zones if they are here, at least I would hope we don't.

There are 3 ways to verify your status.
- Call IRCC and ask if it's valid. Fastest
- Submit a web form. Slowest
- Book a ticket and you will know it's not valid if they don't let you board the airplane.

For lost WP, you can either submit a webform explaining why it got lost in mail or submit a verification of status request to get a copy.

If the WP extension is approved as you claim, CBSA can print you a copy on arrival too. IMO, your trv and wp are valid so you can travel.

There's nothing to worry about. You current work permit wont be invalidated if you get a refusal. And you are not on maintained status while your current work permit is valid and it will stay valid if you get refused. Only you are approved, your previous work permit gets invalid.

There's nothing to worry about. You current work permit wont be invalidated if you get a refusal. And you are not on maintained status while your current work permit is valid and it will stay valid if you get refused. Only you are approved, your previous work permit gets invalid.

Don't rely too much on what IRCC call agents say, unfortunately they are not very competent oftentimes and can't be the source of truth for sure.

Again, in your case, I would rather check of you are eligible for extension. It depends specifically on when you arrived and when you were approved for CUAET. That's an issue mostly.

What I mean is that you can apply on or before March 31, 2025. only if your CUAET application was approved before February 4, 2024 and you arrived in Canada on or before March 31, 2024..
