Hi,
I have been working in Canada for the past 1.5 years. My current work permit is going to expire 8 months from now in January 2024. I will be eligible to extend the work permit for about 3 years. I have the following 2 questions. Just need suggestion so that I can plan things properly.

1) What is the recommended timeframe to start my Visa extension process?
2) I want to bring my spouse to Canada and want to initiate her Dependent visa process by the end of June 2023 (2 months from now). Will this be a problem considering my current Work Permit is valid until Jan'24? Please advise.

Regards,

Regards,

What kind of WP do you have? There is no such thing as a dependent visa. You apply for an OWP as a spouse so commonly referred to as SOWP even if they have no intention to work. The processing will likely take many months so it is tough to say how the fact that your WP expires in Jan 2024 will impact the application. Processing can take many months so you may want to apply for both right now.

What type of permit? Is your husband in Canada as a visitor or worker?

Work permit
What type - closed, PGWP? is your spouse in Canada and what is his status? When does your work permit expire? When are you returning to work? For him to apply for SOWP, you need to show employment letters, payslips etc. So not sure if he is eligible. Again need to know type of work permit.

Open work permit
What is your husband’s status in Canada now? SOWP/TRV? So you are on a PGWP? When does it expired?

You should provide proof of employment, pay slips etc. Need to include your work permit to show you have more than 6 months left on permit.

Immediate family members of students/graduates applying for a Post-Graduation Work Permit (PGWP) are eligible to extend their status to match the PGWP.

For your spouse/common-law partner to be able to extend their open work permit for the validity of your PGWP, you must include proof that you have ‘skilled work’ (jobs in TEER categories 0, 1, 2, or 3 in the National Occupational Classification(opens in a new tab)). Without that, your spouse/common-law partner can only extend their status in Canada as a visitor until you can prove your skilled employment.
