Work permit expiring in 1 month !! Need Help

Hi , My work permit expires on 12th June, I have two applications in process , OINP and AINP. I am not too sure about AINp but I applied for OINP on Feb 6th and I am expecting AOR in a month or so followed by nomination. Also, My express entry score is 458. I am planning to apply for work permit extension without anything since paper application processing time is 114 days and will update my file once I receive nomination. I have few questions :

1) Is it mandatory to apply 30 days before my WP expires ?
2) Should I apply work permit and mention I have applied OINP or AINP ?
3) I understand my application will be rejected but is there any other way other than updating my extension application in between ?
4) If I am on implied status , will they still process my OINP or they will reject it ?

Hi Sarah, please note that in order to successfully extend your Work Permit you must have applied for Permanent Residence and have received an Acknowledgement of Receipt.

Without this, IRCC will not extend your Work Permit.

2) Should I apply work permit and mention I have applied OINP or AINP ? You can mention or not, since you do not have AOR from any of them it won't matter. if you get get AOR from EE with Nomination you can apply BOWP.
3) I understand my application will be rejected but is there any other way other than updating my extension application in between ? I believe not, you can send paper WP application to buy time, maybe in mean time you might get either of the nomination or EE ITA
4) If I am on implied status , will they still process my OINP or they will reject it ?under what program did you apply ? they should be able to process it unless it is related with you WP & yeah, forget about AINP they're useless

Hi

I applied under Human capital stream with 1 year of Canadian experience.

If I get OINP nomination in next 3 months , I will easily get ITA and can submit file to Get AOR

Can anyone help me with which application I should be applying for wp extension in my case ,? Same employer, new employer or bowp ?

Any other way out other than this ? I also read if my file gets rejected for being incomplete I wont get implied status benefits and last day of my status in Canada will be considered same day as my wp expires. Anyone who went through this ? Please help me out

@Sarah, Your application to Ontario Human Capital Priorities Stream will still be in process even though you do not have a WP or you are out of Canada.If you are in Canada, please make sure that you remain in legal status and this includes being on a visitor status/implied status. On the other hand you application to AINP will be rejected if you do not hold a WP throughout the time while your application is being processed.

Thank you , I am not concerned about AINP anyways, Based on current processing time I am hoping for OINP atleast by July and then updating my wp application.

Unfortunately you can't apply for work permit extension since you haven't submitted the application for permanent residence. Work permit extension option is available to only those who have already received an ITA and submitted the complete application. If that's not the case, you must stop working in Canada and wait until you receive the ITA, apply for permanent residence and then you can apply for work permit extension.

I am not applying work permit to get approval ,I am applying to buy some extra time untill I recieve OINP nomination, I am well aware that I can't apply without applying for PR

You can apply for EE on implied status
I applied on implied status and then i lost that status after that applied for restoration and i got that

Can u explain were you pnp nominee or got ITA without that ? My Luck is terrible , I appeared for IELTS in Jan 2016 and was expecting result on Feb 6th which could have increased my score from 442 to 458, Unfortunately, my result got delayed untill March 4th and missed two draws in Feb which were under 458 !! I am so pissed of at British Council and all recent EE draws , Missed a huge opportunity.

I got PNP before expiration of my work permit and ITA on the day of my work permit expiration.
If you get PNP then you can easily apply for EE and can get work permit.
But it depends on PNP, that's all i know..

Yes incomplete application cannot benefit from implied status. The immigration consultants and lawyer I talked to did not recommend to go this way. It can be different depending on visa officers but it seems there are certainly risks. I was in the same situation and my visa expires in a week but I decided to apply for visitor visa and stop working.

Its your choice to take risks or not. It is also true there are some people who got on the implied status and bought some more time successfully.
