I have a year of local work experience, arguably 19 months.

I wanted to not risk being so close to the end of my time so I applied for PNP back in October.

My application for PR based on the PNP was rejected because I had a mislabeled document, so my profile was considered incomplete (rookie mistake).

I have done the process, 2 days ago, of new EE profile and PNP extension. If that's granted quickly then there's no issue... I get my invitation to apply and I'm good to get the work permit extension. - - - what do people think of how likely that is? - - -

I should be invited to Canadian experience class with my points, is there any reason why I'd want to wait for the PNP nomination to update my EE profile? I've got 5 months with employer A, 1 month with employer B, and 6 months with employer C. Arguably another half month with employer C, and arguably 6 months with another crew that I thought would be considered self employed but that someone I know successfully used as time employed. I'm working for employer C currently.

I'm just wondering what your thoughts are, if you would be in the same situation.

I could get my employer to rush in an LMIA just so I could prove I'd applied for it, that would give me a decent leeway for waiting for BCPNP to update my EE profile again.

If I were you - I'd stop worrying and wait to be invited to apply for PR in a week.

With your points - it's an automatic ITA with another CEC draw, which will continue for at least a few more months (COVID: Ontario is in full lock down).

I was invited in the previous draw with 462, but had to decline as I wouldn't complete 2 years of work experience even I were to wait 90 days to apply (would reach 2 years a few days after expiry period in fact).

Why didn't you submit your profile to Express Entry 7 months ago?

Well. Confusion and misunderstanding. If you could help me with understanding this all it would be incredible.

It seems like there are strict rules but that applications are case by case...

I did September to May working on fishing boats as a commercial diver. I thought that was seasonal and self employed, but I know someone who used that experience for CEC class successfully.

Also I'm being told that only 30 hour weeks count, so I'm typically only scoring 3 weeks in a month from my time with full time employers.

Probably 30 in every week from May 10 to September 16
September 17 to March 30 is potentially an issue if I get someone in the IRCC that's having a bad day as I was working on boats that might be considered seasonal and self employed. I'd have to argue that even though I was paid by the buyer I was working for the boat owner, and there are boats doing the work all year round. Would it be worth referencing the guy I know who did the work?
I've been working since July 24 for the same employer getting 150-160 hours a month. Usually in blocks of 8 days though.

I applied for and was granted PNP points, I'm just waiting for them to update my EE profile. Should I jump on CEC application when I'm invited or wait until my profile shows the PNP points, given both my concern about running out of time and my concern about how they may look at my hours.

You say you declined because of work experience so you know what I'm describing

My payslips don't show days worked, only hours per month. If they don't look into that in too much detail then I have 48 weeks of employed full time. I also have 27 weeks of what I thought was employed work but the pay structure looks self employed and the work looks seasonal, except I know a guy who used the experience as his CEC work history. (Urchin diving is conducted all year round, and I was working for the guy who owned the boats)

Can I go ahead and act as if it's 75 weeks of work experience with more than 30 hours a week and for employers? It's killing me all these hard definitions they give and then that it's a case by case basis. Can I make my case better by saying "hi, I worked for similar employers and in similar circumstances to another guy"

Whether you were self employed or not is a pretty big deal since you cannot count self employed work experience towards CEC. It's not the type of work that determines if you were self employed or not - but how you were paid. They key question is whether your employer is deducting taxes from your pay and if you received a T4 from your employer at tax time. If the answers to both of these questions are yes, you can count this work experience towards CEC.

Yes, so then that 27 weeks won't count. Except that I know someone personally who got his CEC PR through the exact same work, paid in the exact same way.

Sometimes that certainly happens and something like that is overlooked.

Going by the rules, this work experience doesn't count for CEC.

So you can certainly try, but you would definitely be rolling a dice.

He said that it was a long drawn out discussion wherein he provided significant paperwork from the people he was working for stating that he was working consistently for them, and essentially proved that he was working for them in spite of the method of payment.

If you accept ITA under CEC, then your application will be processed as CEC. The fact you are a PNP nominee will be irrelevant.

You can't have multiple ITAs at one time unfortunately. You can only have one Express Entry profile and one ITA.
