Work Permit Denied

Hello, I have a few questions regarding an issue my friend is having. He has been here for a few years from the UK and he got a work permit. Last year he went to apply and was rejected, he didn't realize he might have to actually leave the country, we aren't sure! Is there any way to check, or someone to contact? Mind you he is now terrified of being deported, and wants to stay in Canada and apply for a citizenship. Any advice at this moment would be greatly appreciated!!

If I understand correctly, your friend was on a work permit for a few years in Canada. Last year he applied to renew / extend his work permit and this application was refused. Is that correct? Did he apply for anything else (restoration of status) after his work permit application was refused? Based on the information you have provided, it does sound like he is now out of status / in Canada illegally. If he's in Canada without status, then the only way to fix this issue is to leave (if the refusal was last year, it's too late to restor his status from within Canada).

FYI - he can't apply for citizenship directly. He must first apply to become a permanent resident of Canada.

Yes, that's pretty much the issue... he needs to apply for citizenship but I guess its too late now? He didn't apply for anything else after his work permit was refused. We need to find out if he has a removal order, and if there is any way if he leaves can he try to get back in ... Its a big mess at the moment!

Again, he doesn't qualify to apply for citizenship. Even if he had a valid work permit, he wouldn't qualify to apply for citizenship. Only permanent residents qualify to apply for citizenship. So he would need to become a permanent resident first. Based on the information you have provided so far, it's not possible to say if he qualifies to apply for PR. How long did he work in Canada legally and what occupation did he have? What were the dates of his legal work in Canada?

If he applied for nothing after the work permit was refused - then he is definitely here illegally / without status. He should leave as soon as possible. Typically the longer a person stays without status, the more difficult it becomes to return later.
