My name is Mohammed .I came to canada on study permit on 27th April 2011.I completed my studies and graduated on 27th April 2012.I applied for Post Graduated Work Permit on 21st June 2012 and got work permit from 27th July 2012 to 27th july 2013(1 year)

I started my job on 17th June 2012 as Kitchen Designer NOCB on my offcamps wp full time after graduation legally ,got my PGWP on 27th july 2013 and my one year will get completed on 17th june 2013.I talk to cic and they say your one year will complete on 27th july 2013 from day you recieved PGWP and you can apply PR UNDER CEC after 27th july 2013 not on 18th july as experiance under offcampus will not be counted OR when you were working while applied for PGWP will not counted

I did 1 year- 3 semester full time course 60 GPA HRS and payed 19000$ fee and recieved only 1 year workpermit and my friend did 2 semester- 8 month course paid 10000$ recieved same 1 year PGWP and student from my class recieved 2 years PGWP.

I want to know how can i request for 1 or 2 months extension for PGWP or on open WP so that i can apply for my PR on 28th july 2013 under CEC get my AOR and apply for Brdge Open WP.Can i reapply for WP extension.

First, the work done AFTER graduation will be counted towards the CEC if you explain it properly. Secondly, your PGWP was issued for the appropriate amount of time. There will be no extension. The amount of fees you paid to go to school doesn't matter. Any program between 8 and 12 months in length qualifies for a 1 year PGWP. If you want to get a new WP to stay and continue working in Canada, your employer will have to apply for an LMO for you.

You can apply but its a risk.
To stay safe, you can apply counting from the date of PGWP.

1- Duration of PGWP = Study Permit: Not to throw you in confusion, or spread any rumors here, I have also heard various statements regarding 2 yr PGWP given to student with only 1 yr of study permit. I know that the cic website clearly states you can only get 1 yr of PGWP if your study permit was for 1yr (or 8 months). No second thoughts in that. But i was told by a laywer in an MP's office, if i had applied for the second year extension on my PGWP, i'd have got it. I know - i just freaked out on the guy - as CIC website is contradictory to what he told me. But it seems CIC does extend your PGWP even if you had 1yr of study permit. If you have financial means - consult your options with a lawyer (NOT immigration consultant but a lawyer)

Best thing to do - If you have personally seen the WP paper of your friend and confirmed that it says 2 years, you may want to ask him what did he specifically write or explained to CIC to get that extra year.

2 - 1yr Work Experience counting: They will start counting from the day you got your PGWP. The CIC guidelines for CEC'2013 are pretty clear on that. They won't consider any experience gained on Off-Campus WP.

3- Beyond PGWP: How to keep you here beyond 28th July 2013. First thing - I'm sure you understand that even if you leave Canada - you are still eligible to apply for CEC based on your 1 yr work experience. But i know that its not preferable to leave the country. If your employer still wants to keep you - its really very easy for them. They wont actually have to go through the LMO process, because its your first extension after PGWP.

PGWP LMO
Employers who want to retain foreign nationals beyond the expiry of their work permit will generally have to obtain a positive LMO. This normally requires that the employer pay the employee the prevailing wage rate for the position and also conduct recruitment. However, where an employer wants to make a permanent job offer in a skilled position to an employee who has a PGWP, then several variations to the normal LMO rules apply.

Do you think if you explain that to your employer they might be able to help you out and get the process rolling to keep you here for 1 more year?
