Withdraw visitor application after i apply for restoration .

Hi

I have a question currently i am under restoration.

I am planning to apply for visitor visa before my 90 days expire.

My BC PNP file was received on Jan 20, 2015 ... so i am waiting for BC PNP to get accepted before my 90 expire but if it doesn't i would apply for visitor

My confusion is if i apply for visitor status and once its in process and if i get my BC PNP during that time .. can i withdraw my application and apply for a work permit based on the support letter from BC PNP.

What do you mean your time for restoration expired?
I thought you were saying, you wanna withdraw your visitor application after your restoration have been approved?

My confusion was let suppose by 80th day i don't get my BC PNP .

I will apply for visitor visa.

But once i apply for visitor visa and i am waiting for its approval

If during that time if i get my BC PNP while my visitor visa application is still in process

Understand that you are NOT "under restoration". You are currently in Canada illegally and it is stupid to wait any longer to apply for Restoration. At any point right now, CBSA can remove you from the country, which will seriously complicate your PR app.

Very bad situation indeed, you should apply for visitor status within restoration period, now you're illegally here.

You should leave Canada immediately.

Stay in Canada illegally will jeopardize your PR.

I hope you stopped working when WP expired, if not you were working illegally.


It's a bad decision let WP expires without take proper action, but it's absolutely wrong let restoration period passo without apply for restoration.

At this point you cannot apply for WP based on PNP, nor visitor status, even you could get PNP refusal (some PNP requires valid WP or valid status).

You should leave immediately and try to come back as visitor. Re-entry can be refused due you over stay here.

I don't think you can do anything else right now, if you continue living here illegally I don't think you can get PNP nor Visitor Status, perhaps you can apply under Compassionate and Humanitarian grounds but I'm not sure.

If you're not wiling to leave Canada, better get legal counsel.

You can have both applications pending, a visitor and worker. You just have to do something before the 90 days expires.

Agreed, so apply ASAP!

I don't recommend to withdraw an application until get some WP or visitor status before, otherwise you could be out of status

Until you actually apply for Restoration, you are not "under restoration" or in "your restoration period". You are in Canada illegally and can be removed at any time.

Restoration. Is it safe? But we have pending PR app with OWP only by paperbased app pur documents as of this time is only temp file number.
