Withdraw spousal application, repercussions on immigrating by myself?

For reasons way too long to explain here, I'll be withdrawing my application (I am the applicant, will file for divorce as well).

Would that have any negative effect on any future application for immigrating to Canada by myself? I was thinking on trying to get a job offer under TN classification (I know that is not a permanent way to settle in Canada) (North American Free Trade Agreement, I am eligible).

But would my withdrawn PR application would have any negative effect on that or any other immigration application?

(After this experience, I'd not apply via spousal sponsorship.. ever hehe)

I do not think so. After all, the applicant withdrawing a spousal PR application shows that they are not just trying to get into Canada by a marriage of convenience, or else they would have continued with the application.

My main concern is that submitting a PR application would show an intent to reside permanently in Canada, it is now withdrawn anyway. But can that be used against me?

A work visa (like the TN) is itself considered not for immigration (so it is temporary)... that is my main concern. Not sure if I am overanalyzing it.

There is nothing will happen to you. I was sponsoring my ex husband but I cancelled that application 2 years ago because he was living with one of his girlfriend while I was in Canada. Now I met a new man that I am sponsoring and I received his CAIPS notes yesterday.

1. you have to answer 'Yes' on all future Canadian immigration forms when it asks if you have ever applied for any type of visa and provide reasons. If you don't and they find out, you would be in trouble for misrepresentation.

2. Well, submitting a permanent residence application means you intend to reside in Canada permanently. :D

3. applying for temporary status(e.g. work visa) may mean your burden of proof is even higher now. Reason being, the sponsorship demonstrates an intent to live in Canada permanently. The good news is Canada allows for dual intent but you must satisfy the visa officer that you will leave Canada at the end of your stay/visit(if you apply for the work visa).

4. due to the sponsorship application, it's possible you may be called for an interview when you apply for a work visa or permanent residence in the future.

So it doesn't affect you in a negative way per se, but just means you need to make sure you have all your ducks in a row.

It could still be a marriage of convenience, the business kind where both the sponsor and applicant have an agreement but things didn't go as planned. Hence the applicant withdraws their application. Not saying that's the case here.

Did you know prior to 2002 I think(if memory serves me well), sponsored spouses where not required to undergo an HIV test as part of the immigration exam? I know this because there is a man from Ontario who contracted HIV from his sponsored wife who used to work in a strip club in Canada. She got a work permit to come to Canada as an exotic dancer even with her status. The man is suing the Canadian gov't, the designated medical practitioner(who did his wife's exam) and the strip club for failing to protect him. That's one example of the benefits sponsored spouses used to enjoy, so you can see why visa officers are merciless when it comes to marriages of convenience.

Thank God everyone immigrating permanently is undergoes an exam.

Thank you all for your answers, I talked to my sponsor about the repercussions that this could have for me, and she is willing to cooperate so that this affects me the least in my future.

I was thinking both of us writing a letter requesting the withdrawal of the application and explaining the reasons why we chose to, would that be a good idea or if there is anything else you guys can think of that could help?

Your the sponsor yours is different. She or he is the applicant

Sad story! But the man is foolish because having a girlfriend or wife as an exotic dancer, he didn't think that could happen? shouldn't he protect himself knowing what that job is about. Yeah well did he win?

It is very sad indeed! You would think a husband and wife would get tested for STDs and other conditions before having unprotected sex. He lost the case, and appeal was dismissed.
