On April 15, 2013 I received this request documents letter. I submitted only the first 2 because they applied to me not the 3rd one.
Letter No 1

This refers to your application for permanent residence in Canada. In order to continue processing the application, we require the following:
A separate and newly completed additional Family form (IMM5406) bearing original signatures please complete the form and sign in all the relevant sections. We require the information requested regarding your spouse in Section A of the form and you are required to sign Section B if you have no children.
Police Clearance: From each Country/sate where the residence period has been six months or longer since the age of 18, provide an original police clearance from the Democratic Republic of Congo
Divorce certificate: If previously married, please provide our office with a divorce certificate (s), application(s) for divorce and divorce order (s)
Should we not receiving the above documents or information within 60 days of the date of this letter we will assume that you are longer interested in admission to Canada and will proceed accordingly with the refusal of your application.
Please note that we do not acknowledge the receipt of correspondence. You should ensure that your response to this letter is sent by secure means given the sometimes unreliable nature of postal facilities in the region. We will resume the processing of your application on receipt of the required documents or information. You will then be notified once all requirements have been met.

On July 31, 2013 the officer made the same mistake and resend a letter to me asking me a divorce Certificate, I replied to him that I never got married before.

On September 13, 2013 s/he realised that s/he wasted our time, s/he sent this email to my husband.

This is in regards to the above sponsorship application.
Please be advised that we require your divorce certificate from you civil marriage to your first wife xxxx xxxxx. You submitted a request for the annulment of your marriage to Ms XXXX, but this is not a divorce certificate. We do not require a divorce certificate from the applicant as she was never previously married.
Processing of the file will continue upon receipt of your divorce certificate.

Here are CIC Screening Process for Family class.
1. Paper Decision/ making sure all information are there / Send AOR
2. Selection Decision/ determining is relationship is bonified/ either request interview/ or original documents and more supporting documents
3. Background/and Security Decision (I know this process can takes months)
4.Medical Review Decision/ and if at this point meds are expired CIC request medical to be extended or redone.
5. Final decision / either request PP/ or deny the applicant...
After reading all this information I have disclosed. I still don't know why it taking an eternity for the rejection letter to come unless they have decided their mind to continue processing my application? It's been 2 months and 1 week since they received the last document they requested. Question:
1.Could my file be under background check that is why it is very quite?
I want to fact in the background of this thread.My husband married his 1st wife in our home country (DRC). His 1st Marriage was a proxy one which took place on 08/ July/ 2010 he submitted everything to Nairobi in 12/11/2010. 3 months later that woman conceived from another man, my husband cancelled that sponsorship on 05/04/2011 but he never got a divorce certificate before he marry me because his first wife did not want to sign it. Now, His second Marriage is mine. He married me on 29/06/2012, he came down here to marry me unlike the first one which he only wrote a letter from Canada to Congo and one of his brothers represented him. We got married on that date I gave you. When he filed my sponsorship to Mississauga, He wrote a letter and certified it at the Police that He cancelled his first marriage and he was approved to be my sponsor. We are in the second stage of the application, the visa post did everything to process my application later on asked for my passport too. Now on September 13, 2013 High Commission of Canada in Kenya Nairobi sent to both of us an email asking my hubby his divorce certificate before they proceed with my application. HERE IS MY QUESTION. His divorce certificate is dated 19/12/2012 but our marriage was 29/06/2012, could this jeopardize the visa that they are about to deliver? People came up with brilliant comments when I asked this question; here is part 2 of the story question. However after it was said and done, my husband got an email from his MP on September 25, 2013 stating that she phoned Ottawa asking them to give her the status of my application. Ottawa said there is a bring forward date of October 30, 2013 and the file will be reviewed on this date, again Ottawa saw that High Commission of Canada in Nairobi noted that they received my husband's divorce certificate on September 18, 2013 when it arrived there. October 31, 2013 MP contacted Nairobi CHC ASKING THE STATUS OF MY APPLICATION. They wrote back on November 01, 2013 saying this:

The application is on queue for review by an officer. We received information from the sponsor in response to our request for a divorce certificate from his previous marriage. Once the review is complete, the client/sponsor will be advised of the next steps.
Should the medicals expire, new instructions will be sent to the client if the officer decides that the client is eligible.
