Will we need a Temporary Resident Visa?

Hi,

I got a job offer in Canada. I was planning to apply for a temporary work permit. My partner wants to come with me, but she got a ticket for reckless driving a year ago. In our home state, (the first) reckless driving ticket is not a criminal offense. Her criminal record according to our home state is clean. We come from a visa-waiver country, so we would typically not need a temporary resident visa.

I have read through the CIC website and it is pretty opaque to me what happens in this case. In most other states reckless driving is a misdemeanor rather than just a ticket. Additionally, we visited Canada twice recent (1 and 4 months ago) and had no trouble whatsoever at the border (we crossed at an airport).

Will we need to disclose the ticket when applying for a work permit? If so, will we need a Temporary Resident Visa as well? Will she still be able to get a work (or study) permit if she needs a TRP?

Thanks

Hi,

you don't need a temporary resident visa if you are from a visa exempt country just present yourself at the port of entry along with your job offer,LMO if applicable and pay the fees, you will be issued a work permit there.
since your partner visited canada 4 months ago and was able to enter with no issues, most likely she does not fall as inadmissible to canada so she will be able to enter canada along with you.
if you will be doing a skilled job in canada NOC A,B or 0 then your partner will be eligible for an open work permit based on yours(she must be either your wife or has enter in a common-law relationship, lived together for at least 12 months and can prove it) not sure though if open work permits can be issued at port of entry since she is entering canada same time as you o she will have to apply for it from inside canada.

good luck.
