Will this application be rejected??

My boyfriend and I have been in common-law for about 5 years since 2012. We were international students and graduated in 2014 and now both hold a valid post graduate work permit. We have entered the express entry pool with two applications in which both I am his common-law spouse. In one of these applications, I will not be accompanying him to Canada (because our score is lower when I do). Luckily, we received an invite with the score 413 in May 2017.

When I was getting my medical exam done, I realized one of the forms that the clinic provided me had asked me if I was ever diagnosed with cancer in the past 5 years. And the answer was yes, however, I have had surgery to have it moved and no further treatment was needed. I have explained to the doctor who saw me that day and provided her with a letter from my doctor stating that the likelihood of re-occurrence is only 2.5%.

My question is, will this affect my boyfriend’s pr application? From what I understand, even if I am not accompanying him in this application, if any of his dependent has illness or health condition that may become a burden to the Canadian health care system, it is likely that he will be rejected.
If he does get rejected, is there any way to appeal and how should I go about it?
I would like to be prepared for the worst case scenario, any advice will be appreciated!

Nelly, first of all, great to know you are better now.

Next - If you are not accompanying him to Canada - his application should be okay. But in the future if he tries to sponsor you (as a PR), then you both might have issues. It's best to talk to a Immigration Lawyer perhaps in this regard?

In your boyfriend's profile where you are not accompanying him, I dont think it will affect his application. As medical is only required for accompanying people. Experts please give your views.

Though I was diagnosed with cancer 18 years back and had doses of chemotherapy. I am fine since then. I, however, contacted another disease now which doesn't needs treatment as of now. In future, one can not be sure. IRCC has passed my medical.
So in your case, you can not anticipate your future and if your chances are only 2.5% then you will definitely pass your medicals. Secondly, if you never had treatment of that cancer then definitely it was not malignant and wont cause any problem for you.

Thank you for replying! I did consult an immigration lawyer, however, he is not really giving me a clear answer and doesn't seem like he wants to take on my case. So I'm posting here hoping to get more information.

Your information is definitely a big relief for me! And it is what I thought at first, but I just want to be prepared if anything comes up!

I am sorry, my bad. Yes medical is needed. I compared the same with other non-accompanying family members.
