i just found this post and it is so like what happened with my husbands interview in Delhi scared now that ours is rejected like this couples did !! read this so bad it is almost same as what happened with my husbands interview scary now I think wil have no choice but to get ready for an appeal bc still no answer and my husband asked for interview in hindi but the man wearing a turban said he does not speak hindi he is Canadian !! he went back next day with the interpreter and then was asked how we talk to each other bc I don't know much nepali and he needed a translator for English like omg ! they almost forced him to get a translator and yes the VO man was very rude , he is my translator when iam in Nepal he corrects me on my English sometimes we have records that we peek on the phone for over 500 min at a time and they ask how we talk to each other wow .I think I know in my heart it is rejected and have to do an appeal ,that means I will file an appeal then go wait with my husband for the time of appeal what else can I do? I miss him to much to keep staying apart from him
Hi Anonymous...My husband had his interview on Nov 2004,,only a few months ago,,and the visa officer was very rude,,and all most angrey like with him..She even pointed her finger at him at one time,,and told him to stop telling her a story,,.He indicated on the application,,that he wanted his interview in english,,but she kept asking him if he wanted a interpertor,,he said no at first,,then finnaly he thought that he would do as she asked,,maybe she would be ok with him..But after that all hell broke lose..Yes i have recieved the refusal letter,,and i have already sent in my appeal into the IAD in Janurary..And yes i know it is going to be along time for this appeal,,because i have phoned to the IAD and talked to them about how long it would probley take to get a hearing...In his last week,,i recieved the CAIPS notes of the visa officer,,i had sent for them myself threw Canadian office here,,and it took 5 weeks for them to get to me..Really,,i can not even believe that in these notes are mistakes..I have not hired a lawyer yet,,as i wanted to get all this information first,,to see what i am dealing with..My husband seems to think i am a lawyer,,as i have picked every untrue word apart that she has wrote in the note?s,,and also the refusal letter..This visa officer has errored in law and fact,,and has also been very bias in her note?s,,and also the caips note?s concerning me..My husband has been married before,,and i have never been married,,but lived common law for 15 years to a previouse partner..Me and my husband knew each other for 3 1/2 years ...I went to India we got married,,the visa officer is even saying our marriage in not valid because my husband is a hindu,,and i am a christion,,and because we did not get married according to the customs,and ritues of my husbands community..But then she goes on to say,,that even if we did have a traditional ceremony,,then still our marriage would not be valid,,because i did not convert to hinduism..But that is all ok,,we did not get married under the provisions of the hindu marriage act 1955 ,because of course i am not hindu,,,we got marriaged under the provisions of The Bombay Registrations of Marriages Act 1953,,which indicates in the rules of it,,that to contract a marriage,means to solomize it in any form or manner..This marriage act is in Gujarat State..You see we had a very small and fast ceromony ,and exchanged rings,by a priest on one day,then we went and registered the marriage at the registrar office,,,and then a few days after,,we had a beautiful reception with some tradition ritues there, we hired a photographer,,and a guy to do vidio,,mine you it was not a big gathering,,but it was at a very big and fancy hotel in Ahmedabad..I stayed in India for 5 weeks,,wow,,i just loved it there,,it is so different then Canada that is for sure..Anyway,,the long of the story is,,that with all this ,the visa officer still refused my husbands application,,but the worst thing was,,she said our marriage was not valid,,so in that my husband is not my spouse,,and she also said our our realtionship was not genuine,,because she said my husband did a divourse of convience with his wife,,just so he could marry me,,and get into Canada..Even tho him and his wife was seperated for 6 years before they got a divorce..All my family here can not belive this,,and all my husbands family and friends can not belive this..Anway,,we have gathered so much new material on this all,,my husband even went to his govermnet there in Gujarat to request as much information on that Bombay Registration Marriage act 1953...We have to show proof now that this is a legal marriage..The one thing i can not understand,,that how can 1 visa lady make her oun rules about marriage there in India,,and also how she can make her oun rules in how she conducts a interview..I have read the rules,and regulations that a visa officer has to abide by,,and let me tell you she had broke alot of those rules in our case..
