wifes visa expiring in nother 10 days , not received the kids visa what to do

Dear sir,
me and my wife have got the pr visas in sept 2009, at the time my wife was pregnant and the doctor who examined our medicals have conformed the same and said he will inform the Canadian hi commission, by the time i was planning my travel to Canada she was in final stages and some of the travel agents have refused verbally in issuing tickets to my wife, and one of my friend who is an Canadian citizen has suggested me to travel alone to Canada and take the landing since if the family status changes the visas will be cancelled, I traveled alone to Canada and upon emergency call receiving from parents i came back to India and then we are blessed with a baby girl.

After getting the birth certificate i have informed the Canadian hi commission about the add-on in my family in new Delhi by sending a fax. , they replied with a link asking me to sponsor my wife and child , i browsed the information on net and understood process, accordingly i have sent the application to Mississauga with fees receipts RPRF fees also, A month later we received a letter saying that they cannot process the application since I am in India, but still they have forwarded the case to New Delhi hi commission,

And from Delhi office they sent me a letter asking to pay RPRF, submit police clearance and passport,

I have mailed them saying RPRF and police clearance is not required for children , they sent a mail saying sorry , and asked me to send the passport only , and I have sent the same on 23rd June, 2010. till now they have not given any proper answer or status ,

My question is that my wife’s Permanent resident visa will expire on 12th August 2010 and I am left with only 10 working days, till now they have not replied , now my baby is only nine months old and it is impossible for me to leave the baby in India since she is on nursing , at the same time I don’t want to loose the immigration visa of my wife to just expire like that, I have sent a fax to Delhi hi commission asking for status on 24th july 2010 and 28th July 2010, and also stated to at least give temporary visa so that the problem is solved but till now no reply, it is getting hectic since I have not booked tickets as I don’t know the status , and to book the same in last minute will be very expensive,

Sir please in this situation please suggest me what should I do?

Can your wife go to Canada just for landing and return to India as early as possible? During this period, can you hire an experienced temporary nanny to take care of your child? I know alot of people have their new borns being take care by maids, grandparents, etc.

Like steaky said, why dont you let your wife land asap ie in the next week or so and then make a return back to india , hiring a nanny or getting you or her parents to babaysit for 2 - 5 days will help clear complications up with immigration and visa expiring. if i were you i will let treavel to land now.

What you should have done was to wait for the baby to be born and have it added to your application. Your visas would have been cancelled but re-issued with the baby's visa.

Now you are in the situation that you must sponsor your baby but as a PR, you must be in Canada to sponsor your baby. That is why Mississauga said they can not process the case and probably also why New Delhi is delaying it. How can New Delhi process your sponsorship if Mississauga has refused you as a sponsor because you are not residing in Canada?

If your wife were the principal applicant here, landing now on a visa she got when she still did not have children without having had the baby added to the application would be seen as misrepresentation. Doing that would prevent her from sponsoring the baby in the future and could even cause her to lose her PR. Since she is not a principal applicant but a dependant, that might not be the case but you need to ask New Delhi for this information and get it verified that it is ok for her to land on the PR visa she gained prior to the baby being born and that there will be no consequences to that before you even consider having her make a quick trip to land.

Otherwise, you have the option of letting her PR visa expire and then you go to Canada and apply to sponsor both your wife and child.
