Wife's Study permit approved; my TRV refused. any suggestions

Hi All,

My wife applied for a study permit and it was approved. But the TRV for myself and my son (1.5 yrs) was rejected citing regulation 179 - that I will return to my home country after the visit to Canada. Another reason was that the VO was not satisfied that I have a legitimate business reason to be in Canada.

I intend to re-apply for the TRV for myself and my son. Her course is for 1 year.
  • I'm showing abt $14,000 CAD as personal funds for us both.
  • Properties valued at around $ 175,000 CAD (Owned by my father)
  • my employment records (with an MNC for the last 5 yrs)
  • All Investments made by myself & parents.
  • my father's business.

So financially, I believe I've demonstrated that I can support myself & my son. Its the 'ties to home country' and reason for me to be in Canada thats difficult to show.

Request your suggestions to make my case stronger. Thanks !

Our TRV was rejected. I have a similar case as yours with no "asset" ownership in my country, India. While, I have a great and well paying small business, and have had a great employment career (even by Canadian standards), and my wife has a steady job.

I have been recommended to show a will or something from my father showing me as legal heir, or partner or co-owner of property. This recommendation has come from earlier successful applicants and not the CHC.

Hey, thanks for your reply barcode !

Hmm, this is something new. I think I should get hold of something like this. Whatever helps strengthen your case should be included I suppose (without going overboard of course)

so what have you planned to do ? Did you wife go for studies ? Am told that if the student decides not to go after getting the visa approved, then the college doesn't refund the fees. So its a huge loss for the student ! nightmare situation infact. :(

You need to somehow show stronger ties to home country and that you will return. It might also help if you show your wife's intention of returning, ageing parents in old country, good job opportunities in old country after her studies are completed etc. because her return can be linked with your return. You are going to Canada with your wife so if she returns then so will you.
