I am in the process of applying for PR for my Thai wife. We have been overseas as I went the international teaching route for 10 years, but I have decided to return to Canada. Both of my sons have been granted Canadian citizenship..one was adopted overseas, and the other is my biological son. Both are my wife's biological sons. Are they included as dependent children for my spouse, even though I am not sponsoring them? I need to know what should be on her generic application form as well as sponsor evaluation and anywhere else the issue of dependent children comes up...they are not being sponsored (ages 12 and 17) as they are Canadian..so they simply accompany me, yes? Please advise...

Hi John,

On the Generic Application Form - IMM 0008, your wife- the principal applicant under dependents, you would include the children
They do not require a medical... just have to be listed as dependents

1. For my sons, what is their visa status as they travel with me as I move from one school to another in different countries..I have written "accompanying". Is this correct?

2. Why is the question on when they have visited Canada greyed out?

3. Since they now go down as dependents on the generic application form, On my wife's generic applicant form question 3, "how many family members, including you are in this application?" do they need to be included there? This applies to question 5 of my sponsor evaluation: "number of family members and persons included in undertakings in effect and not yet in effect". At the moment I have entered 1 in question 4 (myself), 1 in question 5 a) (my wife), and 2 (our sons) for 6b) for a total of 4 in question 7. Is this correct? So, even though the boys are my wife's biological progeny, do they get considered as her dependents or mine or both? A bit confused here..thanks in advance..I don't want to make any mistakes on these volumes of forms.

You DO NOT put the Canadian children on IMM0008. If you look at the beginning of the Dependents section, it states "You must include your spouse or common-law partner, if applicable, and all of your dependent children, and those of your spouse or common-law partner, who are not already permanent residents or citizens of Canada.

They aren't included in the application in question 3, it's just your wife.

Sponsor evaluation question 5, yes, it would be 4 altogether, as this is your info and they are your dependents as well.

Thank you. I removed them from the IM008 form but added them to form IMM5406E..Additional Family information. Is this correct?

What about Additional Dependants/Declaration (IMM 0008DEP)? Are they entered there?

this is driving me nuts..I don't want to make any mistakes regarding who to put down on the forms. Ok, since my two sons, although they are both biologically from my wife ( one by me, and the other adopted...both are Canadian citizens) will not be applying for PR, I have left them off IM008, but declared them on the Sponsor Evaluation. However, my wife has a mother and sister still alive in Thailand. We are not attempting to sponsor them at all, or ever. Do they need to be added somewhere...if so, where please? Crikee, their is Additional Family information and Additional Dependents also for my wife to fill in....Help please...

She can list her family members on the Additional Family form.

John, as you are filling out each form, follow the guide http://www.cic.gc.ca/english/information/applications/guides/3999Etoc.asp. Pretty much all of the answers to your questions are there.

For IMM5406, the guide states "It is very important that you list all of your children (even if they are already permanent residents or citizens of Canada)", so yes, the children need to be listed there.

IMM0008DEP is simply an extension of IMM0008 for people who have more than 5 dependents. You DO NOT list the children there and in fact will not need that form at all.

IMM5406, her parents and all siblings need to be listed, even though they are not being sponsored and are not dependents.

Since you have been so helpful, I may as well ask you some other questions. On her spouse questionnaire (IMM 5490), they ask questions as though we are apart, but we have been married and living together since Sept 2001! From when to when? Well if I say until today, does that imply we will no longer be living together...seriously, they don't seem to be aware of my situation. They ask how much money I give her..as much as she wants? We are together.

They ask for dates I visit her...I don't! We live together as a family and have for 13 years...I suppose I can show visits to Thailand just after we were married and she had to stay there while her visa to Australia (where I was living at the time) was approved.

This looks like a separate piece of paper thing.

In IMM5540 Sonsor Questionnaire..my wife met my family once in avisit to Canada in 2006, and I know the month, but not the days...is this an issue? She met different members at different times and that certainly isn't cataloged.

For the when to when, I think we printed the form out and wrote "Present" instead of putting a date.

Does she work? If she does, I imagine you guys share costs and she is not being supported by you, so just select "No" for that one. If she doesn't work and you are fully supporting her, then put a monthly figure.

For the visiting questions, select "No" and just put "We live together" in the explanation section, that's fine.

Just take a guess at the day, it isn't too important as CIC can't really verify it anyways. We guessed at a few of ours too.

Thanks so much for your help..now the obtaining of police checks from Laos, China, Australia, Thailand and Japan. Three require a request from Immigration Canada..hope that is not too difficult.

I'm back again! Now, regarding supporting documents on the document checklist for sponsored person, it states:


"If your children are adopted, you must include adoption papers and, if the adoption was done according to customary law and not through the courts, evidence of the adoption ceremony such as photographs . If you are divorced or separated, you must include proof that you have custody of the
children, that you have fulfilled all obligations in custody agreements, and that the children are free to move to Canada."


One son is her biological son, but was formally adopted overseas by me in 2007, and is now a Canadian citizen. Does this apply to him?
