Wife refuses to sponsor after 15 years of marriage

Hello guys

I am wondering if anyone knows what to do in this case. Our marriage has been since 2006. Registered legally in British Columbia in Canada. And I have the marriage certificate and my wife is Canadian (born in Canada).

No one filed a divorce yet.

What can I possibly do in this case, as I am unable to even enter the country. I left in 2006. Our relationship went in a rollercoaster since then. But one thing remained solid, which her refusal to sign the sponsorship.

Anything I can do? Any suggestions?

From what I understand you got married and left her right the same year?! Why? Why are you unable to enter the country?

From my point of view, there is nothing you can do if she doesn’t want to sponsor you to be together in Canada. You are married on paper, but seems like in reality you are separated...

Immigration officer refused my request to visit canada. he said I did not provide his with tourist destinations that I would like to visit
in Canada. I did not try to apply for visa again.

Yes, we are practically married on paper. However, I believe I am entitled for a 50/50 split if I file for divorce, correct?

I think a good lawyer can sort everything out for me. perhaps I can give up on the 50/50 split in return of sponsorship and make a deal
with my wife.

You can't force her to sponsor you.

No, you are not automatically entitled to 50%.

Making such a deal is immigration fraud. No one on here is going to help you with that.

She can file for divorce in Canada. You can’t as you aren’t a resident who been here for more than a year. Since you were married in 2006 and left, a 50/50 split would be extremely optimistic as she has obviously managed on her own without you around. Your chances of getting sponsorship are practically zero, as even if she did decide to try (and risk fraud in the process), you haven’t been together in 13 years after a brief marriage. IRCC would immediately flag the application and likely refuse it as a marriage of convenience. You’re also using extortion to obtain a PR, a serious criminal offence in Canada. Best to move on with your life. .

As a legal assistant who worked family law, here is my advice.
1. You will never have a chance and should never have a chance to be in Canada as her spouse. You obviously married her for Canada and she isnt dumb enough to fall for your tricks. You ruin the process for people like me and many on here who have to have their relationship dissected and wait years to be with the person they love.
2. You will never get 1% of anything she owns as in order to get 50% u have to both have worked to build your life together and the property would have to be on in which was matrimonial meaning u lived as husband and wife. Which you did not.
You do not deserve anything from her oe from Canada and if i were her id report you to immigration incase u try to do this to someone else.

Please ask your self why are we still married and she never applied for a divorce yet for 15 years! before
jumping into conclusions.

Anyways, I don't want to get into the details of my personal life. As I am just trying to get to the point here.

So since I am not entitled to get anything out of her if we divorce, will she be able to get something out of me if I move
to canada on an investor visa?

Do you guys understand the situation now? I am afraid to immigrate to canada because of this situation and end up losing
half of my money.

Investor visa is limited to Quebec and takes many years. Nobody can comment on who is entitled to what without information about your marriage but your wife does not have to sponsor you. You will both have to decide whether divorce is a better option for the both of you.

Sounds to me someone is back tracking their true intentions and saying he is afraid to loose half his money. You did state that you are entitied to 50 percent of what she has, but willing to give it up for sponsorship. Sounds pathetically desperate to me. Like someone commented earlier, it’s people like you who ruin this privilege for the rest. If you have been genuinely married for 15 years, I figure you should have been here by now, if she really wanted you here. Stay where you are pal and forget about Canada. Investor visa for someone who has no money and trying to extort their ex-wife! Crazy I tell ya. Act right!!

You can’t force her to sponsor you. You’ve already said she steadfastly refuses, so why continue? Even if she did, you should expect IRCC to refuse your application based on your marriage history. Did you ever consider she may be common law with someone else.

If your spouse refuses to sponsor you so that you can come to Canada and live with her and has not moved to live with you in your country, it is obvious that you do not have a family and you have no case for immigration under family sponsorship program.

Forget sponsorship, you need go worry about divorce.
I assume she did not divorce as its expensive and at this point the marriage isnt affecting her.

I am sorry, but I strongly disagree. If the family sponsorship program is meant to help families come together I would have been in Canada
long time ago and wont even be posting here on this forum.

If you want to bring families together, then you should not make the program exclusive for people who are making money. If this was for families, then
a work permit should be issued immediately after marriage so that the husband can support his family, instead of waiting for a year or so without any income. The what you call (Family program) has destroyed many families so far and kept them apart for decades.

The fact is, its all about the money. And I have worked very hard for my money and I dont want to split it 50/50 with anyone. With that being said, getting my wife to sponsor me by making a good deal with her sounds like the right thing to do. And who knows, maybe if we finally meet together in person we can work things out.

And regarding the cost of the divorce, it does not cost much money, only a couple grands at most if both sides agree to divorce. And if the fact that I did not get her to sign the sponsorship papers as soon as we got married does not prove to the immigration officer that our marriage was 100% genuine in the first place, I dont know what else does!

Are you sure the judge will disregard any request from her to split my money?

I have heard horror stories about divorce cases in North America. Is there a reliable lawyer someone can recommend to me?
