Hello everyone,

my wife will be eligible to apply for citizenship first half of June, while I would only be eligible a bit later in August (well, only if Bill C-24 hasn't come into effect by then).

My company wants to relocate me to the US for some time, and it looks like a good opportunity so I would like to take it. However, we both love and call Canada our home, have been living here for six years and want to be able to come back to Canada.

So here's the question : if she applies for citizenship in June, and then I relocate to the US at that time and she stays in Canada until she gets it (we are in the GTA so hopefully it shouldn't take too long), would me being in the US jeopardize her application ? I'm looking for feedback in two scenarios : 1) if the "intent to reside" clause hasn't come into effect at the time of her application, 2) if it has

Thanks so much for your advice, sharing experience, etc.

If you apply now, the intend to reside clause will not affect your wife's citizenship application as the 4/6 year and intend to reside have not come into effect. As long as you submit the application in before the new 4/6 year rule kick in, your wife can stay with you in US awaiting citizenship.

This is correct in theory.
In reality, CO can ask questions about your work during interview and if she answers that you work in USA, this might trigger more questions and even RQ, depending on the officer conducting the interview...
Bottom line, get your wife prepared to answer such questions... that's all you can do

I just have a simple advise. I don't know if you have any kids but if you have and they will be schooled in Canada and living with their mom then this is in your benefit and it helps a lot prove Canada is HOME for you and your family. In any case, and this is the advise, if you go to US make sure you come back to visit whenever it's possible it would be better for both of you if you come to Canada(your home) instead of your wife going very often to visit you in US. Also keep track of all your entry/exist records(stamps, tickets, CC slips showing you were in Canada on this or that date...anything that shows your link to Canada. Finally, I don't think this will affect your wife's file just, if she's asked, let her tell them you're in US temporarly on a mission. ;) ;)

Thanks to all three of you guys for your input !

Looking forward to more people sharing their experience / input.
