My name is Ming Tan. I have a question to ask who are expert in this field of spouse sponsorship.. Please help me .
I came to canada in 1991 then 1992 I lived with a woman for 9 years without marriage certificate. One day, of the year 2000 i found her got an affair then I left, however We have 3 children together. I left her never see each other except I visited to see my sons and daughters.
2013, I went back to my country to make a marriage with other woman. When I sponsor her , The government denied and accused me bigamy.
They rejected my application ? why????????????????????? I don't know why?????????? . I don't have marriage ceritficate with previouse woman .I dont live with her for 12 years ..how come government said that ????Please give an advice .

Interesting, also uses different "real" names when posting.

Bigamy means there is some belief that the person was still engaged with both relationships. So, there must have been a civil union of some sort, or because he or his spouse didn't seek a resolution in Family Court regarding support for the spouse or the children.

If they have proof that the OP has actually committed bigamy, the second marriage could be declared null.

ALL KIDS ARE MORE THAN 18 YEARS OLD NOW . I DID SUPPORT SINCE I LEFT HOME. I DID NOT OWN ANY ARREARS CHILD SUPPORT FROM GOVERNMEN. YOU KNOW I AND HER NEVER DECLARE COMMON LAW RELATIONSHIP. JUST STAY TOGETHER AND HAVE 3 CHILD. THEN I FOUND OUT SHE GOT AFFAIR THEN I LEFT. did I Declaration of Severance of Common Law Relationship? Yes. I did.

It's possible that your common law relationship was deemed a marriage-like relationship, so they technically declared you married even if you didn't legally marry. There are certain provinces that treat common law like it's a real marriage by granting common law partners the same rights as married.

Just because you didn't declare common law doesn't mean that you weren't common law. Could you copy/paste CIC's refusal letter describing how you commited bigamy, and post it here? That might shed some light as to why you got refused

Then be polite and ask without pretending to be someone else or do your own research by searching this forum like the rest of us.

It is possible that the couple you are helping have not given you all the facts. Common-law is treated like marriage in every province in Canada except Quebec, but the fact remains, it is not marriage, and once the common-law relationship is over, the people involved are free to marry someone else.
Maybe the man said they were common-law, but actually they had some kind of religious ceremony that Canada would recognize. In that case, he would need a divorce certificate.
It is also possible that CIC made a mistake. Has he ordered his GCMS notes? If he really was in a common-law relationship only, he has proof of the dissolution of the common-law relationship, and he got married after the common-law relationship ended, then he is not guilty of bigamy.
