They gave him the opportunity to prove all the evidences that he stated above details (sent) but still no updates !!! Medical got expired in June 2016!! No remedial request yet !!!

Unfortunately, that is only an average time. There really is no set time limit and it depends on individual cases. There are many people who have to wait significantly longer than the posted averages.

one of my friend he overstayed in UK and removed from there about 8 yrs before.he just get his ppr yesterday he applied in December 8,2016.but he was honest in his application about his removal orders.so dnt hide anything.

My common law partner is still overstaying in UK. Will it be a problem? At Aujla8, was your friend asked to send any additional information about his overstay?

there is a option in the form imm5669 about previous overstays,detentions etc.so he mentioned everything there.but he WS removed from UK and he is in his home country when he applied.it is best do not hide because if in a later dates ircc will came to know it will look more worse.so the golden rule is be honest.many applicants who don't have a legal status in Canada even get the spouse visas suçcessfully.

you can understand that removal situation is worse than just merely a overstay.

Your situation is completely different than the situation of the people in this discussion. They were all applying for permanent residency through spousal sponsorship (they were being sponsored by their Canadian spouses). When you apply for PR, overstays are generally forgiven.

You are applying for a study permit which is a temporary visa. Overstays are a big problem for study permits and generally make it very difficult or impossible to be approved. If you want to come to study in Canada, you will first of all need to demonstrate you are a genuine student. This means that you should be planning to study here at the PhD level. You will also need to show extremely strong ties to your home country to demonstrate that you have no plans on remaining in Canada long term. Lastly, you will need to be 100% honest about your overstay in your application. If you aren't, you can expect the visa to be refused and be banned from Canada for 5 years for misrepresentation.

If you are still in the UK illegally and haven't left - there's zero chance a visa to Canada will be approved and you shouldn't bother applying.

If the person is still living illegally in UK, the PR application will be sent to the home country for processing regardless whether this person is in UK now or not. This person would have no choice but to leave UK to home country to deal with any issues CIC may have.

The person I was responding to is applying for a study permit - not PR. Regardless - no chance of a study permit being approved if they're still in the UK illegally.
Sorry, I thought this person wanted to consider applying for study visa as a option before submitting PR application.
