The way I read the OP, the question that should be asked is . . . "Which VO for ... <<insert home country for wife here>>"? Ireland is where you are both going, not where she is from, correct?

True, I believe the rule is you must be legally admitted for at least 1 year to use a VO outside your home country.

Yes she had been approved for residency allowing employment. I have never heard of that rule that a Visa Office cannot be used until 1 year in the resident country. Like I said I am a Canadian Citizen so I may sponsor from any country as long as im a resident of it.

No, it's at least one year. She doesn't have to live there for 1 year first. If you need an interview (and you probably will if she was rejected the first time), she needs to be able to get to the VO. So her visa must be good for at least one year after applying.

It has nothing to do with you, the sponsor.

yes I agree ^^

I believe your wife needs to be legally in Ireland for at least 1 year before you can choose to apply through that country and not your wifes home country.

I have seen people on this forum choose a specific country they wanted to use as a visa office and than CIC for some reason or another doesn't allow it and goes back to choosing there home country.

Im going to try and find if there is any info about it on the CIC website for you

That's my understanding also. You can put down whichever VO that you think you like, but it's not really the applicant's choice (let alone the sponsor)... CIC (Mississauga) will forward it to the correct Visa Office - in "their" mind.

don't confuse the OP, the operative phrase is admitted. If his spouse arrived in Ireland today, and was admitted/allowed to remain until 05/07/14, then he could submit the sponsorship tomorrow and select London as the processing office.

PMM yes thats what I also heard recently. Something along the lines if the residency there is approved for a year then a local visa office may be selected.

Thank you everyone for the replies much appreciated

Really?
When we were leaving Canada, we were going to go to London and apply outland from London(with a work visa), since my husband didn't want to go back to his home country. Both CBSA and our immigration consultant told us they would still do his app through Mexico city unless he was in London for at least one year.

Hmm that's a pain! too late now lol. but good to know, I guess there is some confusion with the wording.
And CBSA has told us so many different versions of everything, they are never on the same page :-\

Thanks PMM!

The regulations are pretty clear.

"11. (1) An application for a permanent resident visa — other than an application for a permanent resident visa made under Part 8 — must be made to the immigration office that serves

(a) the country where the applicant is residing, if the applicant has been lawfully admitted to that country for a period of at least one year; or

(b) the applicant's country of nationality or, if the applicant is stateless, their country of habitual residence other than a country in which they are residing without having been lawfully admitted.

That's great!,
But unfortunately there is no guarantee CIC will chose Ireland as the VO even when requested, if they feel you have more ties to your home country. Worth a try though!
