where to declare my spouse's student visa status

Hello,
My husband will be coming over to Canada soon. He'll be coming in on a student visa, and meanwhile I'm applying for his PR as the sponsor. Where do we indicate he will be residing in Canada on a student visa on his PR application?

Also is it advisable to back date our forms? The reason why I ask is because in about two weeks my husband will be in Canada and we'll be living together at another address. Rather than updating all of our forms in two weeks I thought it would be easier to detail the changes on a separate sheet.

So I assume you want to apply outland?

I think it would be much much less complicated if you wait until your husband arrive Canada because:

1) If your husband has an PR app in progress and try to enter into Canada using a study visa, CBSA might decline his entry due to concern of over-staying (you can legally over-stay under the implied status but you can't say this is what you gonna do at the broader)

2) If your husband is asked to be interviewed, he has to travel back home to be interviewed (interruption of school work?)

3) In-land application only takes 10~12 months now. In the meantime, your husband can study and work part-time (20hrs/week max). I am not sure about applying for a family class OWP (open work permit) because one of the conditions of a study permit is that you intend to study full-time.

4) Once you two live together in BC (get a joint bank account, co-sign rental agreement, have IDs under the same address etc), the proof of relationship is much more convincing.

5) It is not advisable to change mailing address during the application, if you have read some people's experiences here you will understand that it takes CIC forever to acknowledge address changes (and sometimes not consistently)

6) If you apply in-land, your husband will be required to submit a copy of his study permit (proof of legal status in Canada)

It asks for status in IMM0008, Question 10 - Current country of Residence.

1. Incorrect. CBSA recognizes dual intent and the fact that a person applying for PR is following the rules to live in Canada. There is pretty much no chance of refusal on entry.

2. OP's spouse is British. The chances of an interview are so low as to not be considered.

3. Some inland apps are being processed faster. Many are not. Outland is still faster.

4. The burden of proof for a Canadian-British couple is low. They should have no issues applying now.

5. It's perfectly fine to change address mid-application. My partner and I did it without issue, as have many others.

6. Not sure what you mean by that.

So that means a change in address, and my status from full employment to a unemployed. I have RRSP to meet the minimum financial requirements to support us both but I was wondering if being unemployed would hurt my chances of sponsoring him?

Also on the document checklist it doesn't specify we need to include IMM 3901 (Country specific Instructions) which requires supplementary travel information and a checklist for the immigrant. As this is an outland application do we need to include this form?

There is no need to tell CIC about your employement status. Just make sure it's accurate as of the time you send the app.

Yes, the country-specific checklist is most definitely required. As stated in the checklist, the supplementary travel form is for those applying to Paris, so if that is your office, then yes, you need it as well.

Hello,
I'm a bit confused about filling out form IMM 3901. I'm applying for my husband's PR using the Outland application, but he'll be in Canada soon under a student visa. So would we include IMM3901 in our application package when we send it off to Ottawa?

I've been told he can apply as an Outland applicant even though he'll have been living in Canada when the application gets processed. Can I safely assume that we should send everything to Ottawa?

Everything gets sent to Mississauga. CIC will then forward it to the relevant VO, which may or may not be Ottawa depending on the applicant country of origin.
IMM3901 appears to be a checklist, so yes, you must include that.
