Where to apply :Buffalo or NewDelhi ???

I will be applying under CEC in September but am confused as to where to apply:
Buffalo or New Delhi ???
I am on my PGWP which will expire in March 2012 so after that I will have to go back to India if my employers don’t give me an LMO.I am planning to get married in December 2011.If I apply in Buffalo my main concern is the interview coz even if I get US visa it will be very difficult for my fiancée to get or we both might not get US visa !!! But if I apply in New Delhi there will be no hurdles !!! Please correct me if I am wrong ??
Also if I apply for US visa will they grant me only till the expiry of my Canadian work permit or the standard 1 year or 10 years ???
Also since I have lived in UK for 2 years do I need to send PCC from UK as well as India with my CEC application ???

For more information I had previously applied for PR but it was rejected coz of lack of 1 Year continuous employment and thats the reason I might be called for an interview.

You are wrong, sorry. All CEC applications are processed at Buffalo (or they may be finalized at one of the other US consulates). If you submit your application to New Delhi, they will simply forward the application to Buffalo. You will have exactly the same hurdles, no matter whether you submit to Buffalo or New Delhi.

You'll be happy to know that rule no longer exists (the "continuous" part that is). It is unlikely that you would be called for an interview for that reason. Just be 100% honest about it.

Correct, the hurdles are the same. In the (unlikely) event that you're called for an interview, you might be able to do it in New Delhi. ("Other visa offices may be called upon to conduct interviews for the Buffalo visa office should the need arise." —Operational Manual OP 25)

The only benefit of sending the application to New Delhi would be to pay the application fee in local currency, or by a more convenient means than what Buffalo accepts. I don't know the particulars for New Delhi, but the visa office in Berlin accepts bank transfers in euros (for most people with a German bank account, that's much more convenient than any of Buffalo's forms of payment).

Hey I am in the same boat you are .

I even confused where to apply from buffalo or New Delhi. just becase of interview and other hurdles we can handle easliy.

BUT what I learn from experience of other members here is that

1. It does not matter where you apply , CEC file will be processed by Buffalo or any other consulate in USA.
2. In this context , I understand that "Other visa offices" pointing to "Visa offices in USA"

you need to present your self for interview where currently your file is being processed. Even if you submit it to New delhi they will forward it to bufallo.

Based on this , I have choose to go with Bufalo office to apply for my CEC rather than Delhi.

I don't think so. OP 25 continues: "...These interviews may be required to confirm aspects of the client's eligibility, including the need to interview family members as part of the application process." Family members will often not be living in the US.

Based on this , I have choose to go with Bufalo office to apply for my CEC rather than Delhi.

The only difference is that the means of payment allowed by New Delhi may be more convenient.

I am more concerned about the interview call for my fiancee coz he will have issues to get US visa.Just a quick question as I am on PGWP which expires in May 2012,if I apply for US visa will I get one till my PGWP expiry or for 5 years ???

I called CIC call centre to inquire further in following matter.

Yes, as per them, if there is a need arise for interview then processing consulate will scheduled the interview with local consulate where applicant CURRENTLY LOCATED.

This is should like this only.

Duke, Unfortunately, call centre agents are not always reliable and may mix up FSW and CEC rules. But if that is true that would be a very useful improvement in policy.

So I just found this in the most recent OP 25 (p. 21):

"Note: Other visa offices may be called upon to conduct interviews for the Buffalo visa office
should the need arise. These interviews may be required to confirm aspects of the client’s
eligibility, including the need to interview family members as part of the application process."

Honestly, the interview is the least of your worries. Don't let this stop you from applying.

Yea from OP25 it looks like we can face interview at local consulate where we are currently residing.

While calling call centre agent , I cleared mention about CEC.

Any ways , Yeah you are right ,interview should be least of worries. But still we should have enought information about possible different processing flows.
