When to Apply for Conjugal Spouse Sponsorship?

I am in a conjugal relationship and my partner would like to sponsor me to come and live permanently in British Columbia. I am a US citizen and stayed with my partner last Fall for seven weeks, after which I returned to the states, where I live. I am now back in Canada and will be staying with my partner for the next three months, after which I will return to the states as I cannot stay permanently in Canada. If I am supposed to live with my partner for twelve consecutive months BEFORE applying, how can I do that if I am not allowed to stay in the country that long as a non-resident?

If you are living in the US you wont qualify for conjugal class as there has to be a legal or immigration barrier preventing you from living together or getting married. You can enter canada as a tourist and stay for 6 months and then extend it for a year, or you can get married and apply spousal outland.

I think you mean common-law, not conjugal. As @tdsw26 above says, you do not qualify for conjugal partnership.

You can:
  • Enter for six months and apply for a status extension with the express purpose of qualifying for common law
  • Stay for six months, return to the US for a day or two, and then return to Canada
  • Live for six months with your partner and then have them live with you for six months - you don't have to spend 12 months at the same address, just 12 months consecutively together.
  • Get married and not worry about the twelve-month qualifier.
