What to do when employer refuses to provide letter of employment.

The immigration officer needs you to show that you are actually doing the above duties. Since, your “supervisor” is not welling to voucher the above duties for you. I assume that your relationship with your current supervisor has already “fried” last year.


To show the immigration officer that you are actually do the above duties, you might want to have co-workers, clients or anybody involved with your daily tasks to help you out. (You do have co-workers or clients in your work environment right?)

1. Do you have co-workers that do the same daily tasks as you? Ask them to write a letter for you stating that they are your co-workers and have been working with you for the past xxx years performing the above duties. (Before asking them to do this, take them out to have a beer or coffee (after work), your chance of getting the letters will greatly improved)
2. Copies of email, fax or other correspondence between you and your coworkers, supervisors, or clients discussing any issues arising when performing any of the above duties during the past years. Have a certified public accountant certify that the issue arising is in fact related any of the above tasks (this might cause you some money).
3. Any copies of computer logs showing you log-in the accounting system and performing the above duties. You might need your IT administrator to print this out and certify the access logs belong to you.

Yep, this is a lot work. Yes, it's much easier if you can just get your supervisor to write you a reference letter, if the relationship is still there.
Careful about points 2 and 3, bank communications and systems are classified as internal, and in some cases confidential. Copying them/forwarding them outside the network, etc is a very nice way to get fired.

#1 could be a creative solution if going up the chain of command doesn't work out.

Ginnypi. This is why I liked the CRA reference. It is black and white. One government agency confounding the requirements of another. Agree that producing internal documents without explicit approval could place ssparkles in a dangerous position.
I wish this situation had never happened, but it is heartwarming to see how much support and determination there is on forum to help you succeed.

GinnyPi - I do believe I consulted and received help from many in the forum, people of authority at the bank, kept in mind my own standing in this whole situation before initiating these steps. I hope I am right.

Fonpi - However at the same time I still am thinking about the CRA point. Still thinking on how to make it work for me. I just feel when people not familiar with immigration etc hear the word 'immigration' 'government' 'cra' they just freak out. So is the nature of the drama queen bank manager. As soon as I mention anything about CRA she is going to get her guard up and basically it might get very complicated and not help me in the end. I don't know, I'm just speculating based on her personality.

With what you said as to the relationship with my manager being fried, this wasn't the case. I stopped working there last year in May coz my work permit expired. We left in good terms as i at that time had made it a point to do so. I asked her playing 'nice' for about 3 months after a lot of back and forth and involving a whole lot of things at the end agency's help it was. But i accepted it and moved on......only for it to come back at me right now.

This manager is one of those hard cruel by the book type of people. So now that I have to ask her again, I don't see being nice is going to work. I have to be firm I don't need to be mean and that's what i'm doing. She doesn't have a problem agreeing with what my job duties are, she has a problem putting it down on paper with BMO on it!
1. co-workers are there and I might have to go down that route sometime soon. One of the co-workers is my very good friend so it should be okay. But they can only send me personal emails but nothing official from the bank.
2. I would not use any copies of any correspondence because its all confidential and I've signed stuff in the past that I have to keep it confidential. So that is not an option.
3. As fr IT - Do not have access to anything like that since I don't work there also I don't think it would be legal.

CEC2013 - A drink usually would work lol.

Move 1 : As expected my manager didn't reply at all. I emailed her at 7:45 am.
Move 2: I forwarded the same email with a little note to her manager just now (4:00pm end of the day). Just a basic could you please review as I have not heard from my manager on this urgent matter.

I'll wait till Monday evening.

I Just got the letter ...............................

Instead of being EXCITED I am SHOCKED.

This letter that I chased for 3 months (Jan-April 2011) and left my job and still tried (May 2011) before i finally applied with the agency letter in june COULD HAVE BEEN GOT IN LESS THAN 9 HOURS!

Looking back it was just that manager. I won't do it but I feel like just sending her a TERRIBLE EMAIL right now! Ughhhhhhhh.

PLEASE LEARN - Put your foot down. Do not fear losing your job or souring relations. Go as high up as need be. Do not just accept 'its bank policy it can't be done'! Go to more people than just your supervisor or manager.

I am glad I got it, but I feel sick now.

Yes it was her manager who signed the letter with what I asked. It was sent by his executive assistant. As for my manager she didn't even reply. I suppose when you've done wrong to someone its hard to face that person even with words.

I'm relieved and trying to feel happy but just feel it was so wrong for her to do that! :mad:

Anyway I have it and GinnyPi *Happy Dance* it is!!!! ;D

I think that strong handed approach worked. hmm I think you have to set a no nonsense approach with some.

I applied for CEC and got an email from CIC like this.

This refers to your application for permanent residence in Canada. Please note that your file is in process and will continue to be processed at the Case Processing Pilot-Ottawa (“CPP-O”) office. I am writing you this letter to express my serious concern(s) regarding your application.

You have requested assessment under the occupation of software developer NOC 2174.


Then officer said that the reference letter and the initial offer letter from the company has different addresses but the company's website still has old address [i.e. the one mentioned in the initial offer letter ].

It will be necessary for you to address these concerns and provide further information to support your work experience in Canada for the company during your qualifying eligibility period. It will be necessary for you to provide Company's operations in Canada, your physical employment in Canada for the company (if this includes work at client sites you may provide evidence of this) and documents to substantiate paid employment in last 3 years such as contracts between you and the company and its clients.

You may submit any other additional information and/or documentation that you believe would allay my concern(s). You have 30 days from the date of this letter to submit the additional information and/ or documentation to the above address.

I guess they are searching a lot on google with company name and since it is a small company they got suspicious.
Actually the company moved last year but in company`s website it was not updated . I raised this with concerned department and they fixed the address issue.

What do they mean by 'physical employment in canada' Would'nt T4 and Notice of Assesment Suffice. I mainly work for my employer in his office for their product and sometimes to go some ad hoc client's site on very small projects and some days from home.

What exactly they mean by ' contracts between you and the company ' . The offer letter serves as a contract between me and my company, I don't know what else to provide here ?

Regarding 'necessary for you to provide Company's operations in Canada' I have asked my employer and they are ready to reply CIC directly with some additional information/documents pertaining to this point.

Guys, I really need some help here. Any pointers ??
