What to do if the driver do not have US visa while flagpoling?

Hello, I just have a question regarding on flagpoling. If a driver do not have a US visa, can he just drive me to the US side and wait outside while I try to get the "rejection slip" in the office?

If the driver does not have a US visa, can he come back? Where I live right now, it is very hard to find someone who has US visa and can drive long distance to the border.

If there any way to work around this? Does it work if the driver just do a U-turn right after going through the Canada checkpoint, so that we can go right back to the checkpoint without go to US side? Will it be a problem if I do not have a "rejection slip" from US? I know the bridge doesn't allow pedestrian walking across.

Does anyone know about this. Thank you.

Hello, sir. From what I found online, it seems the bridge does not allow walking. Do you know if I can call the checkpoint office and ask them about the walking, or is there any way to 100% confirm about this?

You do not need US visa for flag polling.

Just cross the Canada Border and when you are about to enter the US border inform the US immigration officer that you are there for flag poling and would like to return to Canada and land there as a Permanent Resident. The US immigration officials will give you a piece of paper and ask you to turn back from the secondary check point. The paper that is given simply states that you refused to enter US and has no impact on your immigration record.

Its that simple.

Alternatively, you can get a appointment at a CIC location within Canada.

Hello, sir. I know pedestrian can walk in rainbow bridge. But the bridge that is closest to me don't allow for walking. Do you know if I can actually call the checkpoint office to confirm about walking across it just in case new rule has applied?

Hello, legalfalcon. Thank you very much for your information. I know that I do not need to US visa to do flagpoling. But I do not have a driver license and I can't drive. So someone has to drive to US checkpoint and back. So does the driver need to have a US visa?

If you are not entering the US, you do not need a US driving license. However, if you have a Canadian driver's license, you can drive in the US. If you have a driver driving you, he will return back along with you and therefore does not need a US driver's license.

Your driver does not need a US visitors visa since you will not enter the US, however, when you re-enter Canada, you need to prove your credentials and a passport is required to re-enter. I wonder how your driver can enter Canada without a passport, unless you have some other documentation.,

He will be good and you will be good if you mention that you are there for solely landing purposes. Some US offices issue a admin refusal letter but it doesnt hamper your chances or the drivers chances of applying for any US/canadian visa..its just protocol...anyone who does a canadian landing doesnt require to have a us visa..dont freak out logo..you and your driver will be fine my brother..relax and be confident my friend

Hello, lazybone, thank you very much for the explanation and clarification. Can I just have one last question. When I come back with my driver from the US side(I think both of us will have the "admin refusal slip" from US officer), should both of us go through the Canada immigration office and let Canadian officer know that I am flagpoling and he is only driving me? Or he doesn't even need to go through Canadian immigration, and he can just keep the slip and wait in the car at outside?

Hello, legalfalcon. I should have clarified that the driver doesn't have a canada passport. But he has a foreign passport with a canadian work permit and entry visa.

So it seems like he needs to hand over the his passport to the officer at the US side and get the "refusal slip" in order to come back, the same as what I do.

To put things is perspective here it goes:

1. Leave Canada by car and reach the US border.
2. Inform the US immigration officer that you want to head back and are re-entering Canada as a Permanent Resident. You may be given a piece of paper with an administrative refusal (not always given)
3. You turn around and then reach the Canadian border, and inform the Canadian officer that you are there for landing as a PR, and your driver is re-entering Canada.
4. You will be asked to go to secondary and park your car.
5. You will park your car, and enter the building.
6. At the building you will be called to the desk where you will present your papers and finish your landing formalities.
7. At this time your driver will either meet another officer the same one who is dealing with you, show his passport and his legal status in Canada.
8. Once the formalities are done, you can drive your car back.

There is no need to worry, and if at any stage you have an concern or a problem, ask the officers for assistance. There is nothing to worry about.
