What is the appeal procedure in case of rejection for FSW applications?

Hi all,

Could somebody explain do FSW applicants who get rejection have appeal rights? If so, how to lodge the appeal? Any time limits for filing an appeal? How much time it will take to get a decision on appeal?

Please kindly reply senior members and anybody who has an idea about appeal procedure. Thank you very much.

1. There are no appeal rights. You can either request reconsideration by the Program Manager, or you apply for leave to Appeal to the Federal Court of Canada. You have 30 dyas.

Thank you PMM for your kind response. One more question, to apply for reconsideration to the Programme Manager, should the applicant need to apply to the same visa office who rejected it, addressing to the Programe Manager. Should the applicant need to fill any specific form or just an ordinary email/letter will do? Is there any time limit for reconsideration applications and approximately how much time it will take to process a reconsideration application?

1. The office that refused the application and a letter outlining why there was an error in their calculation of your points. Don't hold your breath, very very very few ever succeed in convincing the program manager that an error was made in the assessment.

Nit4canada, Is it for you or someone else? If you have been rejected, can tell some of the details so that the juniors may be benefited.

Hi Rocky,

Not yet. Somebody in the forum said that they got the reply on the 14th day. The website says they will respond with in 28 days. I will update you once i have something from them. Thanks

Hi vmpvmp, No its not in respect of my case. It was just a general query. I hope i will not have to go through that appeal procedure!!! Thanks

Daam you mean they will take 28 days to respond to online query that too much a time. How about sending them an email?

Unfortunately thats the service time they say in website. They prefer case specific queries to be sent through the website in the prescribed way. I don't know whether they will reply to normal emails. Lets see, any way...

Dont worry, we should get medicals and ppt soon. Rest I will wait till next week and then will send case specific inquiry and email both

rockey, Both, case specific inquiry & normal E-mail reach to the same E-mail address. So don't send duplicate query as they say not to do that. I have tried both ways preciously, of course, on different occasions!

They do reply normal mails even if there is no file number received.

In simple queries they reply even within a week, though in the machine generated automated E-mail (which you will receive within minutes) confirming receipt of your E-mail, they state time limit as 28 days.
