Since you are now without status anyway, and will still need to disclose this information in your application (even if you apply for ROS), it's not going to matter to the CIC offficer, IMO. You [will have] corrected the problem by voluntarily leaving Canada, which still shows that you were `doing the right thing'.

Just my $0.02 worth. I'd love to hear what others have to say about this.

Thanks for all your help Ponga, I really appreciate everyones great work on this forum!

My work permit expired on August 8, so I have been without status for about 3 weeks. I applied for the new work permit though a month in before the expired date but it unfortunately came through refused on the 9th, so I had to quit work on the spot and now been jobless since. So basically my partner and I are now just looking for the best way for the best way for me to get my PR and back to work, whilst allowing me to leave the country. I just hope I can apply without my birth certificate, maybe I can tell them I will provide once in Oz?

My other quick fix option is to ether cross the border and turn around and come back in, or fly out and come back in. I have been told this would however be incredibly risky since it will show a work permit refusal and a month without status. Someone did explain to me though what I should do is pay for my PR application and then take the receipts with me. Then explain to the officer that I left the country in order to validate my status and be here legally whilst I process my PR. Have u heard or has anyone reading this done this successfully? Do you think it is still a risky move?

It's impossible for anyone here to say whether or not that would work, but here are two possible scenarios:

1. The CBSA officer sees that you're trying to do what is needed to stay legal during the process. S/he approves your request and allows you back into Canada.

2. The CBSA officer refuses you re-entry, but also issues an Exclusion Order, banning you from re-entering Canada for one year or more.

Unfortunately, the `mood' of the CBSA officer that you encounter plays a part in his/her decision.

Since you have lost your legal status and are still in Canada...no idea what would happen.

But, again...once you leave Canada any legal status that you may have regained leaves with you, so...is it worth the added angst for such a short stay (assuming you leave in December)?

Agreed Ponga I guess the risk is just too big regarding such a short stay, especially when I have the option to restore a visitor visa from the comfort of my home inside Canada. Can't be taking such life changing challenges based on the mood of someone I have never met. Outland PR application here we go, lots of documents to start collecting. Sucks we don't have a lease agreement, will get written letters from people who have sublet and luckily have lots of bank statements.

What was the verdict on being able to apply without a birth cert?

AFAIK, the copy of your birth certificate needs to be sent with the application. There's a very good chance that without it, your entire application would be returned.

Since you plan to be in Australia for the duration of the process, are you going to use someone's address there as your own?

Ok for anyone reading this thread who is stuck without a certificate, they can be ordered online quite easily. This is how to apply for a British one.

Also I wonder if I went to the border at Niagra I could speak to some of the officers down there before actually leaving the border? Surely they could offer some advice on the situation? But I also guess I run the risk of them detaining me on the spot. The only reason I would rather get my a visa sorted is I just read that being out of status means I have no form of insurance cover and that is pretty scary.

CBSA is not going to tell you anything different than what you've heard here. Going to the border without status or a PR app submitted is risky.

You won't have health coverage for quite awhile. Even if you were to regain status as a visitor, either through Restoration or flagpoling, you won't qualify for OHIP. After landing as a PR, it will be another 3 months before you qualify for coverage.

I suggest you get your outland app together and submitted ASAP. You don't require status to apply.

Are you dual Australian and British? Your previous posts say Australia but your last posts states you applied for a British birth cert.
