What does overstaying in Canada means? Is it cummulative? or based on last entry

I am a permanent resident of the US so I can enter Canada with out a visa.

My wife who is under the live-in-caregiver program (economic category) sponsored (submitted application August 2011) me to join her, that means if approved, we will have our PR at the same time. I had my medical examination last April 2014 and submitted all required documents in June 2014. But up to now CIC never made any decision yet. My friends, who submitted their docs and had medical exam same time with me, are all landed immigrants now that is why I worry a lot, "why the processing of our papers are being delayed?"

The only thing I can think of right now is that I might have overstayed in canada since I frequently cross the border by land. My understanding was if I stay in canada for say, 4 months and leave, when I re-enter canada again in just a few days, and stay in canada again in 4 months, the 6 months will be re-set, thus, I will have another six months and therefore I did not overstay.

I have been doing my research about this topic but up to now I havn't seen a clear-cut policy. Is it cumulative 6 months in a 12-month period? or 6 months upon your last entry? Please help.

Hi, thanks for your answer. To add more info, my paper is being process by the consulate general of canada in LA, CA.

I entered canada by land staying from 1-4 months at a time but back again in just a few days for 6 times last year. I needed to come back to take care of my wife who had a car accident in 2014.

In 2013, that was again the case, she had surgery. Had to sacrifice my job to take care of a loved one, thus ruining my green card by not meeting residency requirement. If our PR application in Canada will not be approved, this means a double jeopardy will happen to us.

But since you just say, "6 months from your last entry," I did not "overstay" in canada. Am I just over thinking about it? You bet, this is a life changing event that can happen to us - up or dowwwwnn.

You are massively over-thinking things.

Even if it was an overstay - Canada is far (far far) more lax than the US about overstays. An overstay isn't grounds for refusal of PR.

Thank you for your reply. My wife and I will have restful nights and peace of mind ahead of us knowing I did not overstay in Canada.

:)
