What do I do if I think they've made a mistake?

I've received a job offer for a position in Vancouver and applied for a work permit. I was hoping to start work on 13th January 2016 so it's urgent that I can get one as soon as possible, if possible. The permit has been refused on the following grounds:

1.

You have not demonstrated that you come within the exceptions under section 186 of the regulations exempting you from the requirement to obtain a work permit or that your employment in Canada comes within the exceptions to section 203 of the regulations. As a result, your offer of employment must be the subject of determination labour market impact assessment before a work permit can be issued to you. Your employer in Canada should contact the local office of Service Canada to begin this process.
2.

You have indicated you are applying for a C50 LMIA exempt Work Permit however you have failed to demonstrate you meet the eligibility requirements of this exemption.


I was wondering if you would be able to explain what part of section 186 and 203 this applies to? I applied for the C50 LMIA exempt Work Permit because the position is with a registered charity, and the work I'm doing is charitable.

It seems as if they've made a mistake, what can I do about this? What steps should I take?

Any help would be hugely appreciated!!

What's the organization? What's your role? What evidence did you submit to prove they meet CIC registered charity definition.

I would be employed by the Charity Science Foundation of Canada and my role would be 'Program and Educational Officer'. The duties include directing money to effective global poverty programs through issuing grants and educating the public.

I gave these details in the form.

R205(d) Labour Market Impact Assessment (LMIA) exemption applies to charitable or religious workers who are carrying out duties for a Canadian religious or charitable organization and the duties themselves are of a charitable or religious nature (e.g., teachers assistant supplied by a charitable organization to a school because funds were not available for the school to hire.) An administrator or office manager’s duties in a charitable organization would generally not be of a ‘charitable nature’.
