I got this letter today on 16 march. I applied for pr and got my file back because of cap reached. That'y why didn't get AOR and my bowp application is rejected. No I am on implied status and today is my last day of implied status. Please help what can i do now. To apply for visitor visa with restoration or work permit with restoration. As this letter says you have to give $355 as a fee which include restoration+work permit fee. But I think m not eligible for any work permit. Please help me...

This letter refers to your application for a work permit. Your application as requested is refused.
[X] Foreign Nationals currently in Canada who have submitted an application for permanent residence (PR) under the Provincial Nominee Program (PNP) and who meet program eligibility requirements, may be considered for a bridging open work permit (WP) if their current WP will soon expire. To be eligible for this bridging open WP, the following must be met:

- You must have valid status on a work permit that is due to expire within four months

- You must currently be in Canada and have made an application for an open Work
Permit

- You have received a positive eligibility decision on your PR application (Acknowledgment of Receipt letter or e-mail has been sent to you by the Centralized Intake Office)

- You must submit a letter from the province that nominated you under the Provincial Nominee Program that DOES NOT stipulate conditions or restrictions indicating you must work for a Specific Employer, or work Under a Specific National Occupational
Classification Code. (If these stipulations exist on your Nomination, you are NOT eligible for a bridging open work permit)

Your status in Canada is valid until Marcn 16,2015.

[X] We also wish to advise you that your temporary resident status expired on march 16,2015.

You may apply for restoration if, within 90 days from the expiry of your temporary resident status you submit:
• a completed application form;
• applicable fees for restoration and for the immigration document(s) in the amount of
$355.00. Payments should be made online at www.cic.gc.ca. When
you are finished, you must print the receipt of payment and include it with your application. If you are unable to pay online, please contact the Immigration Call Centre,
toll free, at 1-888-242-2100.

You are not under implied status anymore. Your status expired on the first second of March 16th.

What were the reasons for refusal of a BOWP?

What was your status before entering implied status?

Why do you think you are not eligible for a work permit restoration?

1) I got refusal because I dont have a positive AOR from CIC. (Because I applied in november 2014 and CEC CAP got reached and they send my application back.)
2) My status was a worker before implied status.
3) I am eligible for restoration but not for any work permit as per my knowledge but If you know about how I am eligible for work permit then please help.

someone told me that in this condition you can only apply a visitor visa with restoration.

For sure you can only get restoration via visitor visa.

You are ineligible for work permit assuming there were no grounds for you to extend existing work permit. It would have been PGWP or IEC or something like that and obviously you don't have an employer to get you an LMIA.

Older CEC applications are lost now. So your only chance would be to get a visitor visa for six months. During that time apply via Express entry and get an AOR / first stage approval (of course assuming you got an ITA by then).

You have to stop working for now.

And if you apply for restoration, it is common sense to submit any express entry profile details so they know you have a chance of getting ITA soon. I assume even without job offer you should at least have a high score at least 400+ to have any chance of getting ITA latter.

If you haven't applied for EE or haven't planned, i doubt CIC would consider restoration for a few months because there won't be any visible ground for you to get legal status beyond that visitor period.
