What can cause Rejections?!

Hello everyone,

New member here, I am applying for immigration under FSW NOC1122, (Praying I make it in this years quota).

I have hired a consultant and received the forms, document checklists etc. (Nothing submitted yet am still filling out the forms :-X)

I have a few questions for forum veterans like qorax and others.

1. What can cause a rejection? ( I have done BA in Interactive Animation third class honors, can this be a hindrance) Please list any other causes. (I have a clean Police record etc.)

2. What happens if the years quota is reached? Do the 'excess' applications get rejected automatically or the are carried over to next year or something similar?

3. The consultant says it is 99.99% impossible for a Canadian employer to grant me a HRDC approved job offer, unless I was a Doctor, engineer or similar pattern. How true is this and should i even bother applying for a job IF this is true?

on a side note are there any people/organisations who are willing to assist possible immigrants such as me with getting a job while still under the process?

Some personal information:
-Applying through a consultant based in Dubai. (Living in Dubai since childhood)
-Worked One year as a promotions representative.
-4 years sales and promotions of heavy duty transportation rentals.
-currently working part time advertisement consultant

Some of you might wonder why am I asking these questions even though I have hired a consultant, the reason is obvious I in particular always cross check and this forum seems like a great lace for accurate and valuable information.

I am really sorry to be the bearer of bad news but the cap was recently reached for 1122 http://www.cic.gc.ca/english/immigrate/skilled/complete-applications.asp :( Applications are not carried over to the next year that did make the cap.

Good that you crosschecked with this Forum. The cap for NOC 1122 reached on 22nd August as Wolfy has already informed you.

You can still continue to look for an employer who can help you with LMO and you can land as a temporary Foreign worker. actually, doctors, engineers are all regulated professions and are difficult to pass through the HRSDC process for LMO....just a word of caution that this is a long drawn process that requires a lot of determination, patience and well researched approach.

Or, you may try to find an employer who is willing to apply for an AEO - In this case you would be able to come to Canada when your application of PR is approved.

Apps that don't make the cap are returned to the sender and those apps are not carried over to the next year. I agree with mitali in that you can also look into getting a AEO, its not easy but it can be done. With an AEO you don't have to worry about making the cap.

You or any person can not apply once NOC reached the CAP. if you send your application CIO NS will return your package. They will not carry you application for next year. now CIC announce CAP and NOC list yearly bases.

If you qualified under another NOC and still that NOC have CAP then you can apply otherwise waste of money for courrier, certifications (PCC, IELTS , notary etc) & waste of your time-energy too.

Right Wolvy, Getting employment in Canada is not easy game, once the OP get AEO than he/she apply under FSW2 category, that will not depend on current NOC and CAP. but point systems is same for both FSW applicants (should be qualify 67points minimum).

Try your best.

That's the spirit! :)

Your options are
1) Get a job with an LMO (Labour Market Opinion) from the government. The potential employer needs to provde they have advertised the job for 2 weeks in the last 3 months without a suitable Canadian being found to fill the position. Then you can get a TWP (Temporary Work Permit) and apply for residency under FSW2 whilst working in Canada.

2) Get a job with an AEO (Arranged Employment Offer). This also has to be approved by the goverment in a similar way to LMO, but the difference is that you apply for residency with AEO whilst staying in your own country, and only move to Canada once your residency is approved. This method is harder since few employers are prepared to wait 12+ months for your visa to be approved.

Also you can look into Provincial Nomination. If your job is on the local province's skills list they can sponsor your residency application. You will still need to get a job offer but it won't need to be accompanied by an LMO/AOE (as far as I am aware, but not an expert on Provincial Nomination).
