Hi Everyone,

I have been reading a lot lately about this conjugal partner. Me and my partner are thinking if we are eligible and what are the chances of getting approved. I have seen many times that conjugal partner is the hardest to apply and get approved. To begin with, we are on the same sex relationship. Me and my partner met last 2013. We are both Philippine National. She is residing in Canada while I'm here in Singapore as worker. Our relationship went officially on March 2014. She made 2 visit already up to this moment. Her 1st visit was on March 2013 (our first physical meeting). Second was on Feb 2015 (11th Month of our relationship). Asian countries (Singapore, Philippines) to name a few, don't recognize same sex marriage. In Singapore, I only have work visa (s pass) to sustain my stay here. She is in Canada holding a permanent resident. I can say that, our relationship is genuine. Both our families, friends and close friends acknowledge and know our relationship even from the beginning. When she visited me here, we went for several travel (vacations). We have proofs of conversations, photos, calls, emails, letters and other means of communications. Also during our vacation, she gave me a promise ring (diamond ring). Will it help in some ways? Unfortunately, we don't have any bank account, properties and the like having our both names on it. Will this will cause a great effect on our application in the event? Can someone help me with some valid information. I have been so anxious about this thing. We don't know any other ways to be with one another again. The feeling is just so hard and painful knowing that you can't leave together. :( Please help! :(

I'm not sure that you qualify in the conjugal partner category:

- it is not illegal to be a lesbian in either Singapore or the Philippines
- you could get married in Canada

Can you make common law by having your partner live with you in Singapore or Phillipines for 12 months?
Have you tried applying for a visitor visa to Canada? If you can get a visitor visa to Canada you could get married here or live together for 12 months and make common law. If you haven't applied for a visitor visa to Canada yet, you need to do so because if it is denied, it is another thing for proof for conjugal.

Hello! I really appreciate your view on this. Thank you. On the comment below, yes it's not illegal to be lesbian in Singapore/Philippines, just that we are looking for a long term plan. If she go here in Singapore, she will need to find a new job to make her stay legal. As of now, it's very hard to secure job for foreigner like us. The only way to make her stay legal is to secure a job. Yes, we can marry in Canada for sure but we are just checking other options actually so we thought of conjugal partner. I didnt apply yet for Tourist/Visit Visa. Once we get denied by this category, we will then proceed to tourist VISA.

to qualify for conjugal, you have to be able to prove there is a barrier to you getting married. if the applicant can get a visa to go to canada, then that means there isn't a barrier. the sponsor not being able to get a job in the applicant's home country isn't considered a barrier, as that's still your choice to not pursue it as an option, even though it's difficult to achieve. Since it's still possible, it's not a true barrier.

The way people prove there IS a barrier is to apply for a visitor visa to canada or another country where same sex marriage is legal. If rejected, that will prove there is no possibility of marriage since it's illegal in singapore). i believe people attempt this more than once, and the more rejections, the stronger the case.

Hi Nicah,

Me and my partner applied as conjugal partner for Family Sponsorship in Canada. Few factors or should I say "requirements" for you to be eligible under this application are as follows:

1. you have had a conjugal relationship with your sponsor for at least one year and you could not live together or marry because of
an immigration barrier,
2. your marital status (for example, you are married to someone else and living in a country where divorce is not possible) or
3. your sexual orientation (for example, you are in a same-sex relationship and same-sex marriage is not permitted where you live) and
you can prove there was a reason you could not live together (for example, you were refused long-term stays in each other’s country).

But these factors varies to depending where your partner is in Canada. If in Quebec they have different policies too.

OP got PR within 6 months of application in 2018.
Not sure what he/she went through but he/she is from the Filipins and many of the posts are not in English.
So I don't even know if OP ended up getting married or filed as conjugal. Since the conjugal post was in 2015.
