What are the chances of my Open Work Permit be approved?

Hello all,

I am a Singaporean, I am married to a Canadian citizen by birth a few months ago, and I applied for my Open Work Permit in end of October. I would like to ask if anyone of you would know what are the chances of my application being approved or rejected.

I have completed both Diploma and Bachelor's degree. I have done several temporary jobs during my vacations through my schooling years.

I understand that the Visa Officer has to be satisfied that I will return to my country once my temporary visa has expired, but with my situation, I think I would most likely be rejected right? Because my husband is a Canadian, naturally they would think I would want to stay in Canada permanently. But my reason of applying for a Open Work Permit is that we were only married for a few months and I would like to stay here for some time to see if Canada is suitable for me. I have my family (my mom, my aunties, my uncles, my cousins) back home, does this prove my ties to my country?

Unless there are details you haven't provided, the open work permit is definitely going to be refused. It has nothing to do with whether you want to stay in Canada permanently or not. Open work permits are only granted to people with very specific conditions. And being married to a Canadian doesn't qualify you to apply for an open work permit.

Are the other details you haven't provided that you believe qualify you for an open work permit? Did you complete your studies in Canada?

I also went to a settlement advisor of a newcomers community (recommended by the Immigration hotline operator), in the city, to ask about more information about Open Work Permit.

The settlement advisor stated that I could apply for the Open Work Permit. That is why I was sure that I am eligible to apply. I am aware that the eligibility to apply does not equate to being approved.

Note: A work or study permit, or a Temporary Resident visa is not a Temporary Resident Permit. These documents are clearly marked as visas or work and study permits. You are not a temporary resident permit holder unless you are inadmissible and you have been issued a document specifically identified as a Temporary Resident Permit. TRPs are only issued in exceptional circumstance and at the discretion of the processing officer. A TRP may be cancelled at any time.

One of the eligibility to apply for Open Work Permit is that the person is granted "at least six months of Temporary Residency", which in this case, that I am holding Singapore passport - Yes, I am granted six months upon entry to Canada.

You have misunderstood the requirement. You don't qualify for an open work permit and your application is going to be refused. Only people who entered Canada on a temporary resident PERMIT qualify for an open work permit under the clause you have quoted above. Temporary resident permits are very difficult to obtain and are only given to people who would otherwise be inadmissible to Canada due to a crime or a similar situation. There is a special application process to obtain a temporary resident permit. Since you entered on just your passport, you definitely don't hold a temporary resident permit. pzzrsw - Here's the full quote of who is eligible for an open work permit (you gave a partial quote only). As you can clearly see, it applies to individuals with temporary resident permits only hence you don't qualify.

Now I do not understand why that settlement advisor had told me that I would be eligible to apply after I specifically asked him if a Temporary Resident Visa is the same as a Temporary Resident Permit.
