In your first post, you said you'd lived together before coming to Canada. If it was directly before last June, and if there wasn't more than a week or 2 of separation before he came to Canada, then you can include that time in the common-law count. If you were apart for more than 3 weeks, then it's best to start the 1 year clock again.

Assuming the clock started June 2013, if he has lived with you since the day he came to Canada, then you guys will be common-law as of this June. I suggest he extend his status for a few weeks, just to give a bit of a buffer time on the common-law clock. You can then return to the UK and immediately put together a common-law sponsorship app. It usually takes at least 4-6 weeks to put an app together. If you're motivated, you can do it in just a few weeks; you would need to schedule the medical and order any necessary police certificates ahead of time, as they generally take longer than a few weeks. An outland app through London is averaging around 7 months right now, so if you get the app together and submitted quickly, he could be a PR by this time next year.

Yeah no we lived together April 2012-September 2012 in England and then did long distance until June 2013 when he arrived in Canada and we moved in together. So our common law "officially" begins June 1st of this year. I think we're going to end up doing Outland application because from the sounds of it that's better/faster for us.

If you guys are on the ball, you could easily get your app submitted in July and he'll most likely be a PR early next year.

yeah that's what we're hoping to do... but the CIC website when I checked said 11 months for processing outland. Do they usually inflate so not to give hope?

The times listed there are the times in which 80% of the applications were completed. So 20% took longer than 11 months, but 80% were done within 11 months *or less*. Here's a link to a data set that has a bit more info: http://data.gc.ca/data/en/dataset/427337d0-7c36-4fed-8428-c6a63f8c19b3. Takes a little while to figure the spreadsheet out, but if you play with it a bit, you can find that for spouses and partners, from October 1, 2012 to September 30, 2013, 20% of apps were completed within 6 months, 50% were completed within 8 months, and 80% were completed within 10 months. Putting together a strong, well-organized application, including solid proof (think quality, not overwhelming quantity), and making sure not to miss anything can help you get through as quickly as possible. HOWEVER, as in all things with CIC, some of it is pure luck, as they're pretty inconsistent.

As QuebecOkie said above, the average is more like 8 months.

One more tip: if there is a Panel Physician nearby, have him do his medical here in Canada before leaving. It is much more expensive to have it done in the UK.
