My family and I overstayed our visa over 10 years ago and now we are looking to Canada as the best option. Our family consists of two kids, one in their twenties, one child under 18 and my wife and I. Although we are legally separated we will re marry if necessary. I can get references from past employers to assert my past and present work experience but I am not sure which visa or program would be best since I am with my family and my adult child has no work experience but wants to start in Canada. I might need to post this under another topic but if anyone can advice me about what the best way to go about this is, or has any information I might find useful, I would greatly appreciate it, I want to know what my options are since I didn't find anything on the Canadian immigration website about my specific situation.

You have obviously studied the various immigration programs available on the IRCC web site, so I won't repeat the information there. Some things to be aware of.

1) the oldest child is not a dependant for immigration purposes. They will have to seek immigration on their own merit.

2) remarrying for immigration purposes is considered to be marriage fraud and/or misrepresentation.. You don't want to go there..

3) illegal work is not accepted as valid work experience, if I remember correctly. You may have to rely on experience gained before you became an overstayer.

4) you have almost zero chance of being granted any form of temporary resident visa for Canada.

5) claiming refugee status in Canada is probably not a viable option either, given your circumstances.

What field is your education/work experience in? It will need to be in a skilled area that Canada is actually looking for in order to have any hope at qualifying for immigration here.

As mentioned also, only you and your youngest child would able to be included in any immigration application you submitted.

May be you can start with getting a job offer from a Canadian employer and apply for a work permit. Canada follows a point system for express entry permanent residency program where a job offer will count towards significant points required for PR eligibility. But again, that depends on your field of work.

Look for PNP programs under busniess catagory. Manitoba saskwintichen or other may be in east provinces. If money in tune of 200000usd. I think setup up trucking or farming business could be possible. Read every province PNP programs

As I mentioned before, there is no realistic chance of being issued a TRV, even for a work permit. The 10 years (and continuing) overstay in the USA will see to that.
