Hi Everyone,

I have already applied to EE, my current score is 379 but my wife took the IELTS again and we are looking to improve our score to 431. I would like to know the following. IF we get the points and an ITA, after we provide the Police Certificates, get the medical exams. Is it legal to wait for the PR in Canada with our Visitor's Visa as we already have that?

If so, since we wouldn't have the PR at the time of travel, i'm assuming we would need to buy round trip tickets.

Any help would be greatly appreciated! Thanks!

If you have money to burn ten yes, that's a perfect plan as you won't be able to work in Canada and will sit there with your arms crossed waiting.... at 431 it could be a loooooong wait, suggest you sit down for that one ;)
 
If we get an ITA in May/June, we could be talking about getting the PR by December/January and we would like to help my brother and sister in law with my nieces on during the summer break (he lives in Ontario). Also, i come from Dominican Republic and would like to move during the summer break rather than winter to get adjusted.
 
This scenario is only meant if we actually get an ITA and i would be sitting down working actually. I have an arrangement with my current employer to work remotely from Canada.
 
You are only allowed to stay for a maximum of 6 months at a time on a visit visa. The immigration officer would have mentioned the date by which you are to leave the country next to the stamp on your passport when you entered the country.

So you'll anyway have to leave the country. But you can always re-enter if the visa is valid.

You can't move to Canada until you have PR. If you arrive in Canada as visitors and it looks like you're trying to move to Canada, it's quite possible you may be refused entry and sent home. If you say you are coming to take care of your nieces for the summer, it's quite possible CBSA may classify this as working illegally and you'll once again have problems with your entry Canada. IF you decide to come in May/June, travel with minimal personal belongings (what you would take on a 2 week trip to Canada), make sure you have a return ticket, make sure you can demonstrate you have funds to support yourselves without working in Canada, and make sure you can demonstrate some sort of ties to your home country when you enter Canada (e.g. property owned, etc.).

The personal belongings that i would be moving are basically clothes. I am planning to send most of the stuff with a Shipping company and travel light.

Something that came up today while meeting with my bosses is whether i would need to declare my income from my current job. As i mentioned, i would keep my current job and work remotely in Canada and i would still be payed on my Dominican account here. I would be using my card to withdraw the money in Canada or do a Wire Transfer.

So my questions, really are: A) Would i need to declare this income, along with the taxes that i payed in my country? B) Would this income be subject to taxes again in Canada?

For a and b - Not while you're there on a visitors visa. You're generally only considered a fiscal resident (liable to pay income tax) in a country after living there for more than 6 months in a year.

Anyway you're ignoring the fact that a visitors visa is only valid for 6 months! After this time you're unlikely to be able to renew your stay and staying there illegally will jeopardize your chances of getting the PR...

Your plan sounds very risky, what will happen if the CRS cut off doesn't fall to below 431? You've probably noticed that the trend has stopped falling... fact is they have issued too many ITAs and although no one can tell I think it's unlikely it will go back to falling some time soon...
 
Is there a guarantee you will get that language score for sure? Dont be overconfident. I gave 5 attempts of IELTS, one each month from October to February. I had given myself 5 chances and decided that if it didnt happen, i'd enter the pool. I would have had 412 but the score in the 5th attempt bumped me up to 472. I entered the pool in March but I started IELTS and WES simultaneously. Getting the IELTS took me 5 months and I didnt expect it to be that long. You are taking a big risk. Why jeopardise your future in Canada for something so short term. Even I thought of getting to Canada earlier on a visitors visa after submitting eAPR and while PR was under process but decided not to gamble my future.

If you are in Canada already, then you'd just be burning money with no work. I was in a similar situation when I had to quit my job in August 2016. I decided to come to India and then apply from here. Plus, the wait for PR could be a long time, from eAPR Acknowledgment of receipt until PPR. For some, it has gone past 6 months too.
