:(hi. I moved to canada in 2003 through illegal way to apply asylum but unfortunately it was refused but then i made an appeal in court and my decision stay pending.but before any decision i moved back to my home country. later on my daughter moved to canada on permanent basis and she sponsored me for an tourist visa but my visa got refused with reasons THAT MY FIRST ENTRY IN CANADA WAS ILLEGAL. I read an UN document which says that an asylum seeker can choose any way to reach countries loke Canada. I want to prove to immigration that even my entry was illegal but for the purpose it was not illegal as i was an asylum seeker and even then i moved out from Canada voluntarily not being deported.

CAN ANY ONE HELP ME WHERE CAN I APPEAL and how can i appeal to get visa to visit my daughter.

No appeals are allowed for visitor visas. However you can always try to apply again. (You will have to submit a new application and pay the fees again.)

Given that you are a failed asylum seeker and entered Canada illegally in the past (it doesn't matter what the UN document says - Canada will still view the entry as illegal), I think chances are very low you will be approved for a visa. If you want to apply again, forget about trying to prove that your entry was legal from a UN perspective. Instead, try to show additional ties to your current country of residence.

But again, given your past, I think the chances of another refusal are pretty high. It may be more realistic for your daughter to visit you instead.
